PHILADELPHIA, February 8.—A po- liceman pursuin~ a fugitive accidentally shot and killed an innocent bystander at Front and Dock streets today. The victim was Morris Levin of Lakewood, N. The policeman, Frank Brown, was match into a tank of gasoline and kero- sene on the lecture platform. < No sooner had explosive lauids burst into flame than the cell, whose re- sistance to an electric current varies with the amount of light it receives, per- ceiving the first slight shadow of the, cloud of smoke ahich arose from the | tank, altered the current in a wire by | which it was connected to a cylinder of carbon dioxide and before the audience could realize what had happened, a re- lease of gas had extinguished the fire completely. Robert W. Stewart was preparing to return to Chicago today avowing unconcern over claims of victory by the Rocke- feller forces in their battle of proxies. Meanwhile the Rockefeller strength in the battle for control of the Stand- ard Ofl Co.,, of Indiana was augmented by proxies for 2,360 shares forwarded by Dartmouth . College. A brisk exchange of statements was opened by Winthrop W. Aldrich, counsel for the proxy committee, headed by John D. Rockefeller, jr., with the claim that his committee held proxies repre- senting 51 per cent of the stock. Stewart Unimpressed. “This latest claim victory gives me no concern,” Col. Stewart said. “In the ensuing four weeks between now and the annual. meeting the stock- holders will more clearly understand the situation.” ‘The Aldrich statement was the first definite ‘claim made since Mr. Rocke- feller began soliciting proxies with which to vote Col. Stewart out of the chairmanship and directorate of the Standard Oil Co. of Indiana after Col. Stewart had refused to resign. Mr. Rockefeller demanded the resig- nation as'a result of his displeasure with Col. the Senate committee investigating the Teapot Dome oil leases and the affairs of the Continental Trading Co. Col. Stewart said in his statement that he had had a most satisfactory stay in New York and that the results had been ‘most encouraging. Discounts Rosenwald Action. Regarding the action of Julius Rosen- wald of the Sears-Roebuck Co., of Chi- cago, who had written to friends urg- ing them to support the Rockefeller in- terests, Col. Stewart said: “Mr. Rosenwald is not a:stockholder and his connection with Mr. Rocke- feller is well known. His statements show a lack of information.” Among _important elements in the strength Col. Stewart will marshal at Stewart’s testimony before | po: Robert W. Stewart, now battling John D. Rockefeller for control of the Stand- ard Ol Co. of Indiana, was bitterly at- tacked yesterday by Senator Norris, Republican, of Nebraska, who called upon the oil magnate to explain his share of profits from the former Con- tinental Trading Co. The Nebraskan lauded -Mr. Rocke- feller for his attempt to oust Stewart, but he said that he did not enough. He called upon Rockefeller “to accept the doctrine he preaches every Sunday to his Sunday school class and denounce these extortionate profits” of the oil companies. Stewart, he declared, would have been “behind the bars long ago” on his in- dictment for perjury before a Senate committee “if he had been an ordinary working man.” Norris added: “One hundred million dollars is pretty diffi- cult, if not impossible, to convict.” Stewart was acquitted on the perjury charge, Norris also asked Mr. Stewart “in his why the extinct Continental Trading Co. of Canada was organized, and to comment on the language of the Su- preme Court, which declared this com- pany was “created for some illegal pur- se. Recalling the Senate’s inquiry into this transaction, Norris said that Stew- art, Harry F. Sinclair and Harry M. Blackmer and James O'Neil of the Prairie Gas & Oil Co. had organized the company, and that they had bought oil through it at $1.50 a barrel and re- sold it to their companies at $1.75 a barrel. Norris said the men by this deal had taken profits from their companies of between $3,000,000 and $5,000,000.” He declared the four divided the profits, and the Continental Trading Co. went mvolving 30,000,000 barrels of oil.” A Sl ‘The Baltimore & Ohio Railroad was the first use electric power of the the meeting in Whiting, Ind., his sup- porters point to 44,000 shares owned by the Sun Life Insurance Co., of Montreal, and 12,000 shares said to be held by John Eagles of Los Angeles.
