ATLANTA, Ga., October 16.—A re- . ceiver has been asked for the Ku Klux Klan in a petition presented in United | States District Court here alleging that expenditure of money by high officials | of the organization had caused it to be- come insolvent. The petition, presented yestorday to ! Judge Samuel H. Sibley, who ordered it filed, charged that Hiram W. Evans, imperial wizard of the order, and other officials had spent Klan funds in oppos- ing the candidacy of Gov. Alfred E. Smith of New York, Democratic nominee | for President, because of his religion. It was alleged that the organization had become insolvent, although it had collected $100,000,000 from its members, which, the petition said, ““was greatly in excess of the amount necessary to pay its lawful and necessary expenses.” Violation of a Georgia law opposing contributions by a corporation for polit- ical purposes in an election or primary held in this State was charged. Evans in Washington yesterday de- clined to comment on the petition pre- sented by C. T. Rice, who identified himself as a member of the organiza- tion. Another man named as defendant in the petition, James A. Comer of Little Rock, grand dragon of the Arkansas realm and a member of the “board of directors” of the Klan, said the organi- zation was solvent, was not in politics, and, “though unalterably opposed to Alfred E. Smith,” had not spent money for political purposes. In addition to Evans and Comer, W. F. Zummbrun, the Knights of the Ku Klux Klan and the American Building were named as defendants in equity. The defendants were ordered to show cause October 27 why an injunction should not be issued to restrain the de- fendants from dissipating or convert- ing the funds of the Klan and from further contributing to campaign funds as charged, and why a receiver should not be appointed. The petition charged that Evans “un- lawfully perpetuates himself in office as | imperial wizard and unlawfully ap- points the other individual defendants ; as officers of such Klan in direct con- travention of the constitution” of the order, and that members are denied the right of suffrage in election ot the imperial wizard.
