R. & E. motorman. David admitted stopping his car on the tracks at Thirty-sixth street and Prospect avenue, to back into a parking space. Because of the narrowness of the street he was unable to clear the tracks, he said. Before he succeeded in pulling into the parking space, how- ever, Thompson's car came along and stopped so close that David was unable to park. An argument resulted with both men refusing to move.
