THE EVENING STAR, WASHINGTON, D. C. MONDAY, MAY 28, 1928, < PINCHOTONSTAND INVARE HEARIG Senate Subcommittee Opens Probe Into 1926 Pennsyl- vania Eiection Contest. | Rr the Associated Press Opening hearings in the contest of William B. Wilson, Democrat, against Senator-elect William S. Vare in the 1826 Pennsyivania elections, the Senate elections subcommittee today heard Gifford Pinchot, former Governor of Pennsylvania. an opponent of Vare in ;29 Republican senatorial primary of 26 Pinchot was called to the stand by eounsel for Wilson. Counsel for Vare served notice that the inquiry should be confined strictly to the 1026 elec- tion. Questioning of Pinchot about ap- pointment of election officers in 1923 prompted the Vare ultimatum. “We will show,” said Roger B. Ma- hany. counsel for Wilson. “that these ap- | pointments plaved a part in the 1926 | debacle. It is impossible to prove a con- spiracy out of the mouths of the con- spirators.” Senator Waterman. Republican. of Colorado. chairman of the subcommit- tee, sustained the objection of Francis Shurk Brown, counsel for Vare, holding that Pinchot's testimony regarding ap- | pointments could better be supplied b * the ofiicial records on file in Pennsyl- | vania. “Chafl Bex" Hearing. Senator Moses, Republican, New Hampshire, suggested, however, that Pinchot be permitted to go ahead Waterman agreed to do so. with the declaration that “if you want to make ., & chaff box” out of the hearing that it was all right with him . As Mahany asked Pinchot about a special session of the Legislature, called by him in 1926, Waterman ruled the evidence “incompetent.” but he permit- ;Pd Mahany to go ahead along that ine Pinchot said he called the special session for the purpose of revising the election laws, “in order to guarantee clean elections in Pennsylvania.” He vecalled the sppointment by him then of the committee of 76. Counse!l for Vare interposed frequent objections. especially to the admittance in evidence of various reports made by the committee of 76. Pinchot identified the documents, but Senator Waterman in every instance sustained objection to them as evidence. Protests Obstacles. | Mahony ' protested against “drastic and cruel and defeatist obstacles to our | establishing the truth in this case” | and argued that he should have a Jarger Jeeway than that of a court. Senator Waterman declared the dis- “opinions and not findings of fact.” Mahony differed with this interpretation. but the argu- ment was dropped when the Colorado Senator sald he would as he saw fit and told Mahony that he could question any of the rulings before the whole committee later. { examination of Pinchot, Mahony ssked him what he knew of ’ in Pznnmnn; hr:!mu ‘The former governor said first el frauds” during | . _He de- | Philadel- ;.hh by tisburgh by the “Mellon machine.” Delays Merger Suit Decision. n announced cide on motion of the ‘Washington Railway & Electric Co. for | dismiasal of the milt of John J. stockhoider, ' pre- of the traction com- 1o the motion. he Jared. “SEAGULL” FLYERS HERE.
