Patton was discovered last night in a shed at the rear of his home here| by his 18-year-old daughter. He was unable to speak when found, and to- day, after the tar and feathers had ‘been removed at a hospital, he was unable to describe his assailants. Inflammation of the covering of the heart followed. An X-ray located a large pocket of pus back of the organ. In order to remove the poison it was neces- sary for the surgeon to change the position of the heart during the op- eration. For a few seconds, while working back of the heart, the phy- sician held it in his hand. BOSTON.—The omission in the will of Mrs. Annie Draper of Wayland of mention of her son, Willlam W. Dra- rer, who left home 45 rs ago and of whom no wor heard until after his mother's death, was not intentional, but rather occasioned by accident or mistake. This was the decision rendered by Judge Leggat of the Middlesex Probate Court, East Cambridge, recently. The son left home in 1883 at the | age of 20 to seek a fortune. His mother died in 1923, not having heard from him. The will, not mentioning his name, was duly probated and the estate distributed according to its be- quests On the son's recent return he |applied to the court for his share of the estate that he would have re ceived had his mother died intestate. Leonard D. Draper and other heirs filed a bill in equity requesting the court to determine that the omission of the son’s name from the will was intentional on the part of the mother. The equity petition was heard No- vember 1. Counsel for the petitioners argued that the son was presumed to be legallv dead after an absence of more than seven years without word from him.
