LAWYER DESCRIBES SEARLES' LEGACIES Says He Did Not Know Amount Intended for For- mer Elevator Operator. By the Associated Precs NEW YORK. March 1.—In a depo- sition read in nreiie day Lewi Delafield cumstan of th which sh his $15,000,000 estate to his secreary. Avithui Walker. and £10.000 to An gelo M. Hilison, former elevator op- | rato: Lilison is suing to obtain the bulk of the estate, charging Waiker and Delaficld used undue .nfluence which caused his benefactor to cut him off with only $10,000. Delafield said provision for a legacy for Ellison was made in a draft of a wil' he drew a year before Searles died, but said he did not insert the am»int because he did not know what it was to he. . Tells of Canadian Trip. He said he#first heard of Ellison in the Summer of 1919, when Searles told him of an intended trip to Can- ada. Asked if he was going alone, Delafield said Searles replied he was taking Ellison with him. In August, 1919, Delafield testified he suggested that Searles draw up a memorandum as the basis for a will. He said Searles gave him a memoran- @um which Indicated that $2,500,000 of securities was to be set aside for the maintenance of Pine Lodge, Bearles’ estate at Methuen, Mass., and that the lodge and trust fund were to g0 to Mrs. Mary Ellen Rowland and her three sons, of Melrose Park, Pa. Boy Takes Searles’ Name. Delafield said the memorandum directed the three boys should be educated and that Walker should observe how each developed. He said the boy who showed the greatest de- velopment as to character should re- ceive the lodge and trust fund, pro- vided he assumed the name of Searles. During a recess Walker said Searles’ wish in this respect had been carried out and that Benjamin Allen Row- land, aged 17, had taken the name of Searles and will receive the lodge and trust fund when he becomes of age.
