i Pty HEARING RDERED " NPENSIDN FE Injunction Asked by Lawyer to Get One-Third of Fund Recovered. -~ Justick Hoehling of the District Su: preme Court today issued a rule on the three Commissioners of the Dis- trict of Columbia, Daniel J. Donovan, auditor, and James R. Lusby, disburs ng officer, to show cause August 3 why they should not be restrained and enjoined from paying to the 80 indi- viduals claiming under the recent ap- propriation of Congress for back pay and pensions to police and firemen. The order of the court is based on a suit for an injunction filed by Hosea B. Moulton, who seeks to establish his right to a fee of 3315 per cent of the amount recovered, according to the terms of separate contracts which he | & made with each of the persons to be benefitted from the appropriation. Through Attorneys Robert H. McNeill and John W. Maher Moulton asks that the District offi be enjoined from paying out any money from the amount appropriated to persons who signed the powers of attorney held by him. Moulton says that he did not seek the employment, but that repre- | Martha W sentatives of the firemen and police- men solicited his aid in securing the desired legislation. The court is informed that Moulton made unsuccessful attempts before Congress in 1923 and again at the last Congress and it was not until he had prepared and submitted a third bill that he was able to have it passed and to have the appropriation grant- ed. Applicants for his services, Mr. Moulton says, offered to pay him 50 per cent of the amount which should be allowed them, hut he declined the offer and wrote into the agreements a fee of one-third of the amounts to be recovered. A number of the per- sons making the contracts with him, Mr. Moulton says, voluntarily came to his office and paid him. the one- third fee which they had promised. The remaining 80 persons who are |3 named as parties to the suit have de- clined to settle, the lawyer said. The court is asked to enjoin the commissioners and the disbursing of- ficers from paying the money to the claimants and to require these officials to recognize the attorney's lien as disclosed in the powers of attorney. Aid of the court is also asked to pre- vent separate claimants from seeking settlement with the District officials directly with a view of defeating the claim of Attorney Moulton. She also became enraged on occasions and threw mis- siles at him, inflicting bodily harm, he says. Attorney Henry M. Fowler appeared for the husband.
