Magee fired the shots while lying on the floor, the testimony showed. The trial was in progress two days. District Judge Luis E. Armijo, by granting the defense motlon for a directed verdict of not zuilty following the closing of the State's case, took the matter out of the hands of a jury composed of two men who could e#peak and understand English and ten for whom it was necessary to translate every word of the proceed fngs into Spanish. Although_tried many times in the ourts of New Mexico, in the six years he has been a resident of the Btate, the manslaughter charge was the most serious vet faced by Magee. In two previous appearances before the San Miguel district court here Judge Leahy, principal State witness in the recent trial, was the presiding Ju Magee was found guilty of llbel and sentenced by Leahy to a vear in the penitentiary, and again Leahy found Magee guilty of contempt of court and sentenced him to three months in jail.
