ROCKVILLE, Md. November 10.— Drs. Willlam T. Pratt and C. E. Hawks of Rockville yesterday per- formed an autopsy on the body of Thomas A. Simms, 52-year-old con- tractor of Kensington, this county. who was stabbed to death at his home late Saturday afternoon by Fred Athens McClellan, aged 22, former emplove and a boarder for the last ceveral months in the Simms home. A gash across the left side of the neck, about two inches In length, was the only wound disclosed. The jugular vein was severed. State's Attorney John A. Garrett stated today that he has no doubt that the grand jury which convened today will promptly charge McCl lan with first-degree murder. Mrs. Catherine Cox, 25, colored, bride of a month, is being held at the elghth precinct charged with in- flicting a serfous bullet wound on her husband, Elmer Cox, 32, in a fight which occurred between them at their home, 1115 V street, about noon today. The husband is alleged to have possessed.an ax, while the wife had the revolver. It was said at Freed- men’s Hospital, where he was taken, that he may die. Mrs. Cox remained at home until the arrival of Police- P. Myers, who placed her under arrest. In a statement to the police she declared she and her hus- band had quarreled last night over his former sweetheart and a man with whom Mrs. Cox had kept com- pany before her marriage. The automobile which figured in the apprehension of James T. Holmes, Harry W. Freeman and John A, Gross, all colored, and led to their indlct- ment on'a charge of murder in the first degree for the death of Police- man Raymond C. Lelsinger, Augus 28 last, will be admitted in evidence at the trial now in progress of the three men before Chief Justice Mc- Coy in Criminal Division 2. The court last week decided that as the police had taken possession of the car without a search warrant it could not be accepted as evidence against Holmes, from whose garage it had been seized. The other accus- ed cannot clalm any benefit from the alleged illegal violation by the police of Holmes' rights, the court declar- ed today, and so testimony may be presented by the prosecution as to the automobile and its condition as evi- dence against Freeman and Gross.
