Solicitor General Beck has been In- structed by Attorney General Stone to request the Supreme Court to ad- vance the Mal S. Daugherty Senate contempt case on the court docket. The request, Mr. Stone announced today, will be made of the court immediately after it reconvenes early next month. The action follows a conference held last week between Senator Brookhart, chairman of the Senate committee which supoenaed Mr. Daugherty, a brother of the former Attorney General, and Attorney Gen- eral Stone. Mr. Stone said he had asked the committee chairman for “Instructions” as to the _future course, since Federal Judge Cochran in Cincinnati had upheld the conten- tion of Mr. Daugherty that the Senate committee had exceeded its powers in attempting to compel him to appear bofore it and bring records of his bank in Washington Court House, Ohio. The Attorney General regards the case as of high importance, believing that the powers of the Senate can be fully defined by a ruling.of the High Court on the Issues.
