By the Associated Pres DENVER, Colo., September 5.—An auction price of $42,500,000 for the Denver & Rio Grande Western Rail- road will be insisted upon by Harold Palmer of New York, one of the in- terveners in the sale and reorganiza- tion of the system. Palmer appeared last night before a general confer- ence, tend~d by Federal Judge J. Foster Symes and attorneys and bond- holders in the case, to urge the higher upset price. - Other attorneys urged a lower fig- ure, which, they argued, would insure a buyer and the culmination of the reorganization plan as approved ten- tatively by the Interstate Commerce Commission. Calls Price Too High. Petitions were filed by Harold Pal-| mer and A. L. Finkelstein of New York »nd Horace W. Bennett of Den- ver to intervene in the foreclosure brought by the Bankers' Trust Com- pany of New York, trustee, in behalf of approximately 37 per cent of the holders of an issue of $38.000.000 first mortgage and refunding bonds. In denyinz the petitions Judge Symes declared the figure of $42,500,000 was too high, and indicated definitely that a lower figure would be set. Imer declared, however, that his fizure was based on estimates that the road was worth at least $130.- 000,000, As a result of the conference last night, which followed Judge Symes’ refusal to recognize the petitions to intervene, it was announced that the railroad would be placed on the auc- tion biock within the next 60 days. Final reorganization will be com- plete before January 1, 1925, it was said, and control of the system will pass to the Western Pacific and Mis- souri-Pacific railroads. Legal Tangle Ended. Yesterday's action released the corporation from a tangle of litiga- tion and meager financial backing which has prevailed for two years and which was accentuated after de- fault of interest payment on the $38,- ©00.000 bond issue. Under proposed reorganization plans, between $5.000,000 and $10,- 000,000 of new capital will be put into the road in addition to the amount sufficient to up old debts. clear e DRY GOODS MEN HAPPY. Speciel Dispatch to The Star. RICHMOND, Va., September 5. Fifty-three thousand and ten checks, for a total of more than $2,300,000, are being made out. This money goes to the members of the Tobacco Growers' Co-operative ociation and is the third for the 1923 crop. making a total of 756 per cent of the valuation placed on the tobacco by the officers handling the financial affairs of the organization. The checka are made pavable as of Sep- tember 15, and the money comes at a time when the farmers need it. There is comparatively little left of the crop of the preceding vear, and that will be adjusted in a short time and wiped off the books. The mem- bers of the association say-that the third payment will bring them a bet- ter price for their tobacco than when they sold on the public warehouse floors, the vast majority of the mem- bers being pleased with the condi- tions. They still have the fourth payment to wait for, but this is ex- pected to be made before the end of ‘*he year. RUSH FRUIT TO MARKET. SAN FRANCISCO. September 6 (Special).—Shipment of _California apples pears. grapes and peaches which exceeded 10 060 carloads in Au- | gust are expected to exceed 15000 carloads in September. During August grape shipments were 5,304 carloads, or less than half this ar's crop. NEW YORK, September 5.—Definite progress is being made by leading trunk line interests in their plan for rzalignment of Fastern railroads for eventual consolidation, according to representatives who attended a con- ference of Pennsylvania, New York Central, Nickel Plate and Baltimore & Ohio executives here yesterday. With a regrouping, made necessary by the merger activities of the Van Sweringens, the carriers are secking a general agreement on a new plan of consolidation which can be recom- mended to the Interstate Commerce Commission. STEEL MORE ACTIVE. Industry Shows Gradual Improve- ment in August Returns. NEW YORK, September 5.—Grad- ual improvement in the steel industry is reflected in August operations, which averaged slightly more than 50 per cent against 38 per cent in July. The Steel Corporation operated about 50 per cent, compared with 44 per cent the month before, with inde- pendents close to 45 per cent, agalnst 33 per cent In July. The 12 per cent increase in operation was accom- panied by a gain buying of about 15 per cent over July, which showed an improvement of 10 per cent over June. The trade expects this im- provement to continue the rest of the year. PARiS PRiCES EEADY. PARIS, September 5.—Prices were steady on the bourse today. Three per cent rentes rancs 20 centimes. Exchange on London, 84 francs 40 centimes. Five per cent loan, 67 francs. The dollar was quoted at 18 ¢rancs 91 centimes. FULL TIME PREDICTED. Industries in Baltimore Are Stead- ily Speeding Up Work. Spectal Dispatch to The Btar, BALTIMORE, September 5.—Indus- trial plants here are steadily adding to thelr forces and working time 1s gradually being lengthened to such an extent that it is now predicted that most of them will resume full sceduie within 60 days. Inquiries for products are more numerous than for five months. The Bethlehem Steel Corporation, the Bartlett Hayward Company, the Balti- more Tube Company, the Eastern Rolllng Mill Company, the Poole Engineering and Machine Company and the fertilizer companies have in- creascd operations to & marked ex- tent. Maryland farmers are recelving good prices for their crops, and are in the strongest financial position for several years. - WOULD PURCHASE STOCK, THEN ABANDON RAILROAD The Maine Central Raflroad today applied to the Interstate Commerce Commission for authorlty, to acquire control, by purchase of its capital stock, of the Hereford Railway, which operates from Cannan, Vt, to Lime Ridge, Quebec, 53 miles. The road also asked authority to abandon op- eration of the line after the stock had been acquired. The application to acquire control of the road was made, the application stated, in order to release the Maine Central from the lease under which it now operates the Hereford Railway, which is the property of a Canadian corporation. The Maine Central alleges that it has suffered heavy losses for many ars in the operation of the road. SPRINGFIELD, 111, September § (Special).—Employment in this State fell off 2.3 per cent during the last month_as compared with July and pay rolls declined 5.7 per cent in the same pericd.
