20 7 ACQUITTAL IS ASKED _ INWGOD FRAUD SUIT Millionaire Lumberman's Counsel Takes Lead in Asking Dis- missal of U. S. Case. Attorney Wilton J. Lambert today asked Justice Bailey in Criminal Division 2 of the District Supreme Court to direct a verdict of acquittal for his client, John Stephens, million- aire lumberman of Jacksonville, Fla., who has been on trial with five others for several weeks on a charge of con- spiring to defraud the United States out of more thun $1,000,000 in the sale of surplus lumber from Army cantonments. The court had asked the prosecution to show wherein they cxpected to connect Stephens with the conspiracy, and Mr. Lambert directed his argument to the state- ments submitted by the government point 1 for the other four defend- ants will follow Mr. Lambert. At- rank J. Hogan for Ernest C. Morse, former director of sales of the War Department, concluded his ar- gument on the motion for an instruct- ed verdict of acquittal last Thirs- day. The government's counsel will reply to the arguments of counsel for “the defendants. Justico Bailey will not limit the arguments and it is expected they will t several days. The jury again was excused until Wednesday. Stephens Is Defended.
