Moreover, Bergdoll was not negli- gent in broadeasting throughout Ger- many the story of his experiences in | America, at every occasion denounc- !ing the American people and the | American government and maznify- {ing his daring exploits in America. |1s it, therefore, a wonder that he cre- {ated throughout Germany, and par- | ticularly in the province of Baden. {an irritant antagonism toward Amer. a4 and all Americans? Occuples Secure Position. Thus, with the popularity Bergdoll enjoyed in Germany and with the money at his disposition, he assumed a distinction in the land rivaled only by the most famous war heroes. All this, of course, gave Bergdoll a sense of security and immunity from all possible apprehension by or extradi- tion to the American authoritie Nevertheless, that yellow streak of cowardice so typical of Bergdoll, and in spite of his Immunity fr dition by virtue of his u political fugitive from justice, al surged to the level with him, which is evidenced by the fact that he kept bodyguard of about a dozbn men around him at all times. Only too well did he know that he was being sought by the American authorities, nothing did he neglect to assure his { protection, and his good American | dollars, acquired in the land of his birth and his father's birth, under the government, did every possible thing to avoid his paying the penalty for | his sad neglect of sacred duty as a { citizen of America. From all appearances, I venture to say that the entire police force in the state of Baden is in the pay of Berg- doll, and, as I will later show in m account of the famous trial at whi the slacker appeared as the star wit- ness, practically every inhabitant of Eberbach at some ‘time or other has received some portion of the Bergdoh fortune. Every policeman in the state of Baden was in Bergdoll's pay, and hardly a_single inhabitant of the town of Eberbach was not given in- structions to keep a rigid watch on any foreigner coming within the limits of the town. And as it wa: every foreigner was carefully scrut nized at Eberbach. His papers had to be In perfect order, and he was re- quired to show to .the authorities what business brought him to the town, and if he stayed there longer than three days he exposed himself to all kinds of criticism and conjecture as to whether or not he might be there in the quest of information con- cerning Bergdoll. Bergdoll Bribes Frenchman. However, in spite of the careful Vvigilance of the volice and Bergdoll's private spies, our intelligence service succeeded in amassing all the infor- mation relative to the slacker's haunts, habits, social relations, busi- ness dealings, etc. To show how widely the Bergdoll case was known In the allied countries Is evid®nced by the fact that a member of the French secret service succeeded In approaching Bergdoll, turned traitor to his own country for a substantial bribe and offered his services to the slacker for spying upon the activities of the American authorities. This man was later trapped by the Amer- ican intelligence service and convict- ed by the French authorities. By reason of his financial circum- stances and notoriety gained as a true son of the fatherland,” Berg- doll at once became oné of the most prominent social figures in Eberbach and the state of Baden. There was hardly a social event among the up- per circle in and around Eberbach at Wwhich Bergdoll dppeared that he wals not the most outstanding personality, and wherever he was received his ap- pearance was always the occasion for endless applause and high-pitched en- thusiasm over his actions in America- and his successful evasion from the hapds of the American authorities. My colleague was finally {asked if he would not sell the car, {to which he replied in the negative, but remarked that he knew a man at Ludwigshaven, which is in the French occupied zone, just at the boundary line between the occupied and unoccupied territories, who had a Cadillac car, and that he might want to sell it So_they called up the man at Lud- wigshaven, who, having previously been consulted and assented to sell- ing the car, as he had no chauffeur iwho could drive it, agreed to sell the car to Bergdoll. ' Inasmuch as he no driver, he invited Bergdoll to come to Ludwigshaven. This met with his approval and an_appoint- ment was arranged for a few days later—that Bergdoll was to come to dwlgshaven and buy the car and drive it back to Eberbach. Plans Go Wrong. Everything was arranged {most minute details. Upon setting his | foot on French occupied territory the slacker was to be trapped by the merican and French secret police, nfortunately events took a different course. On February 15, 1921, just two days before Bergdoll was scheduled to call for his car at Ludwigshaven, where his delivery into the hands of justice would have been an easy matter, Sergt. Charles O. Life of Americans Threatened. The shot had hardly been fired when the entire population of the town, as it seemed, hastened in the direction of the affray. There was not the slightest chance for any possible escape for the daring sleuths, for before they were aware of what had happened they were encircled by a furious, bloodthirsty mob of excited land revengeful townfolk, who, after { having taken full cognizance of what | had happened, the news of the aj tempted kidnaping having spread like wildfire. throughout the town, were in an uproar of indignation. Shouts of “Kill them! Lynch them! Shoot them! Burn up these American gs!" were heard aplenty. and the attitude of this mob, whose idol and hero had been assailed. ran nothing short of the attitude of a Southern mob In its desire to lynch and admin- ister justice with its own hands. And it was only due to the frantic efforts of the police by making use of their weapons that the mob was prevented from carrying-out its intentions. Under the protection of the local police force, followed by this angry and excited mob, which showed no lack in hurling the vilest epithets at the American detectives and their German associates, Naef and his men were escorted to the local police sta- tion, where they were locked up for safekeeping. And only long after darkness had set in, and after the town authorities had promised the mob_that the offenders would be se- verely dealt with, the crowd slowly dispersed. Draft Dodge Sentence. By the Associated Press. TOPEKA, Kan., June 3.—A petition | asking a Writ of habeas corpus to obtain his release from the federal disciplinary barracks at Eort Leaven- worth was filed in federal court to- | day by Erwin Rudolph Bergdoll, | brother of Grover Cleveland Berg- doll, draft evader. Erwin Bergdoll is serving a four-year sentence on a charge of evading the draft. In his petition Bergdoll attacks the draft law passed May 17, 1917, charg. ing that it violates the federal Con stitution in that “it gives the primai- power to raise an Army, thus . stroying the rights of the six places the states under the comumar of the provost marshal generat and violates the fourteenth amendmer Bergdoll also claims thit a m must enlist before he can becor soldler and that inasmuch as he never enlisted he w not a soldier and can- not be prosecuted as such.
