CHINA SAYS PACTS | MUST BE RATIFIED Contrary to Practice.in - Recent Agreements. BY WILLIAM R. GILES. By Cable to The Btar Chicago Daily News. Cop; 1921, ¥ PEKING, China, December 21.— The- forelgn office cails -attention to the fact that constitutional pro- visions make it necessary that in any international agreement, the part assumed by China must be ratified by the Chinese parliament before becoming valid and operative. Thus any arrangement made by the Chinese delegates in Washington is invalid until ratified by the parlia- ment here. This statement seems strange for, in recent months, Chinese-Siamese, Chinese-German and other treaties have been entered into and are operating without such ratification. ‘The possibility of China’s having a real parliament in the near future is doubtful. The elections, which should have taken place & month ago, have not been held in many provinces, despite repeated orders from the president. May Appeal to Washington. It is bélieved here that this new move means that China intends to appeal to Washington to cancel the twenty-one demands and the financial and other treaties and agreements connected therewith on the ground that they were not ratified by parliament. It must be borne in mind that doth the southern and northern govern- ments have entered into huge details with the Japanese without reference to parliamentary approval. Accord- ing to a Japanese official statement, the northern Chinese owe Japan 180,- 000,000 yen (about $90,000,000) for loans, not one of which was approved by, the Chinese parliament. It must be' remembered, also, that numerous corrupt officials forming the different governments have taken part in these transactions. Nevertheless, being gov- ernment acts, they are to be consid- ered legal; otherwise, any agreement China enters into must be looked upon &8 a mere scrap of paper. ‘While Japan has used every effort ton forwarded to this country the most glowing accounts of China’ success, the “agreement in principl; of the powers being mistaken for the final commission. The proposal to re- establish efficlency in the Chinese post office and China’s national rights concerning the wireless are appreciat- ed by all and the abolition of foreign post offices and.control of the wire- less would not be seriously opposed. Granting China independence in the matter of the customs tariff is con- sidered just, but the cancellation of extraterritoriality is impossible in China’s present state, as is also the demand for other cancellations. Believe Hand Overplayed. It {s considered that China’s dele- gates overplayed their hand, appar- ently mistaking the Washington con- ference for a fairy godmother willing to forgive a spoiled child. China has certaln definite grounds for expect- ing sympathy and assistance from the powers, but they asked for things which could not be granted, depend- ing upon rhetoric instead of sanity to win. It is feared here that because of their failure to secure everything they asked for, the powers will unite against the Chinese, making the situation ‘worse than it was before by substituting collective for fn- dividual spoliation. —_— The Fat Man's Club of Paris, now has fifty-eight members, including three women. PEKING, December 20. — Liang Shih-yi has been named as premier of the Chinese cabinet, to succeed Chin Yun-peng, who, with all his ministers, resigned on Sunflay. The fall of the cabinet followed the arrival here of Gen. Cang Tsoa-lin, governor of Man- churia, who s now engaged in form- ing a coalition government, in which all the reactionary parties are par- ticipating. It is charged that Chin Yung-peng was guilty of peculations and the sale of offices.
