KANSAS CITY, Mo., December 21.— Overturning of the administration of President Alexander Howat of the Kansas Miners'’ Unlon, took place only after Howat had been given re- peated opportunities to present his case and to meet the wishes of the international union by calling off a strike then in progress, John L. Lewis, president of the international, testified late yesterday in the suit brought here by the deposed officidls to restrain the ifnternational from setting up or continuing a provisional administration in the Kansas coal fields. The Howat government was suc- ceeded by a provisional organization established by Lewis. Early this month a temporary injunction was granted against the international of- ficials, and the present proceedings are to determine whether the order shall be made permanent. Sent Two Commissioners. , Mr. Lewis testified that he had sent a commission of two members into Howat's district to present an un- prejudiced report before he took any ction whatever on a formal com- aint of breach of contract made to him b; L. Questioned as to what Howat said about complying with the orders of cutive bgard, Lewis testified: “He said, in substance and effect, that he was out of harmony with the executive board. NEW YORK, December 21.—In con- trast to the joy with which nearly everybody else in the metropolis is looking forward to Christmas, more than 1,000 men, women and children here are preparing for a day made only more bitter by the realisation that they are unhappy in the midst of rejoicing. These are the majority of Uncle Sam’s temporary guests at the Ellis Island immigration station, who are awaiting deportation because quotas permitted their countries are exhaust- ed. It will be, immigration officials say, the saddest Christmas the island has ever seén. . In former years many immigrants have been detained ltytho nation’'s gateway over the holidays, but they were sustained by thoughts of the land of promise lying beyond the wel- coming Statue of Liberty. This year, however, the Titan god- dess stands an obstacle in their path, with upraised hand waving them back to the lands whence they came— lands in which many dismantled their homes to provide passage money to America. By the Associated Pre: ‘WASHBURN, ., December 21.— The latest killing in an Indian feud generations old is charged against John “Red Bird” Beauregard, who was lodged in jall here today and held without bail for the slaying of John Mealey, an aged recluse of the north- ern Wisconsin woods. Chieftains of two Indian tribes have been succes- sive victims.of the reud. Mealey is said to have taunted Beauregard that the latter was ‘not man_enough” to avenge his father's death. Years ago Beauregard's father is said to have avenged.a feud killing by shooting an Indian named “Black- bird.” Not long afterward “Red Bird's” father was shot down, and suspicion pointed to “Big Bone” Lombard. Fif- teen years ago Lombard was slain in a cottage belonging to John Specht, who was convicted on circumstantial evidence and Senf to prison, although he maintained his innocence. While Specht was in prison Charlie “Light- foot” Beauregard, “Red Bird’s” broth- er, attempted to make a death-bed confession of some sort, but the sheriff arrived too late.
