Entertained by Local Knigh<«_ The parade of the Knights of Pythias on Park commission to appraise values—Messrs. | Pennsylvania avenue this morning was a pretty Norris, Seufferte aud Burchetl—resumed ses- sions in the Cireuit Court room. Mr. Conway Robinson calied Mrs. Sarah M. Swart, who testified that the Military road was constructed by the soldiers ix 1861 or "62 to get the guns to the forts. Mr. Perry offered record evidence showing the dedication of Biagden Mill road, Klingle Ford road and other roads. Mr. Maddox ealled Mr. R. E. Pairo, who tes tified to the sale of a iot in Rosemont to J. H. ‘Smyth for 20 cents per foot, anc thought that he said ths park would not take in the ground, and at the time he did not believe it would. Mr. Pairo produced the deed from H. L. Page for 883 9.53 hmong which he laid off into Rose- mont Park, and be had no interest other than in the avenue. Mr. Maddox said that ho would have some evidence as to the value of a well, and also of « ‘spring with an adjoining mint bed. It was asked if there was # sideboard attached. Iu rebuttal W. H. Walsh, a draughtsman, was called by Judge Wiison, and he testified that he had made a contoar map of the 245-acre Sboe- maker tract, enlarged from the vav heretofore im evidence, whick he produced. CIVIL ENGINEER WOWELL. D. J. Howell, civil engineer, textitied that he bad made a number of subdivisions in the Dis- trict, Maryland and Virginia and was the engi- neer of the Zoological Park. He Lad examined the Shoemaker tract and outside of the creck (six and one-balf actes) about ten and oue-half xcres were subject to overtiow, based om a rise | of fifteen fect. Judge Wilson asked as to the overfow on the Warder tract aud Mr. Perry objected and was sustained. Ar. Wilson said that he expected to show by the map le by witness that tract 39 could be subdivided and that the streets and roadways could be corstructed at compara- tively small expense, wakinga very advanta- geous sabdivisio Mr. Perry objected to testimony, but subse- quently withdrew it ‘The commission suggesting that they de- aired all the light possible, the objection us to the Warder tract was withdrawn. Mr. Howell said that 6.5 acres of the Warder tract outside of the 2.9 of the creck were sub- ject to cverfiow. Then by the map he explained | ‘tae lines of the streets and that the grade: wore 10 per cent or less, excepting in afew in- stances they may be 15 ver cent. The lots with one cxception bad fine Luilding sites. The trees were an advantage, he thought, most of them large, fine looking and well propor- tioned. In laying out suc! uddivision his policy was to save the trees, especially the fine onea. The lots were about 3v by 200 feet and the villa lots one to five acres, and with the rocks, trees and ravines it male a diversified | picturesque subdivision. Th> roadways took ‘$2.5 acres and extended 6.75 rules. coco cdi THE BATHING BEACH CLOSED. ‘The Commissioners Think It Too Late in the Season to Bathe, ‘The bathing beach will not be opened again this season. At the board meeting this morn- ing the subject was taken up and discussed at length. The report of the engineer department rela- tive to the soundings that had been made, to- gether with the report of Superintendent W. X. Stevens, was also considered. While not commiting themselves regarding the safety of the beach. the Commissioners agreed that in view of the Inteness of the season it would be best to close th» beach for this year at least. It is understood that the District will be sued by the parents of one of the young men who were drowned there recently. i THE DAMAGED PAVEMENTS. ‘The W. ond G. KR. Company to Make = Deposit and Give a Bond Th» Commissioners today wrote a letter to the president of the Washington and George- town Railroad Company with reference to the damage done to the asphalt pavements of the city by the laying of the temporary tracks dur- ing the construction of the cable road. In view of the importance of this matter to the public the Commissioners say that they deem it their duty to require the railroad com- pany to deposit with collector of faxes such sum of money as shall, in the judgment of the engineer department, be commensurate for the purpose of making the sight. Those in line were members of the Washington, Nelson, Franklin and Concordia divisions uniformed rank. ‘They were marching to music by the Marine Band and were escorting the mom- bers of Wilmington division from the Baltimore and Ohio depot to the sonth front of the treasury, where the visitors and the home divisions were photographed. The first regiment band of Wilmington accompanied the visitors. After being photographed the procession meved down the avenue asfar as Pas Owen House, where dinner was sorved. Church Saturday evening at 8 o'clock Rey. W. M. Frysinger will lecture on ‘Our Methodist Fathers and Mothers,” and on A Husband's Claim for Divorce. George A. Burch by Mr. Eugene F. Arnold. has filed a bill for a divorce from Ella Burch. They were married in Faltimore by Rev. George W. Divine February 16, 1884, the defendant's maiden name being Watts, and he states while residing st 1324 R street the defendant had her brother constantly re- siding with her and ber mother and sister fre- quently visited there, sometimes the mother for three months at a time. against his protests. He charges that on July 16, 1889, with the full knowledge and approval of her relatives she left the house for three weeks and he was unable to learn ber whereabouts and she nested him to take his clothes and leave, and he did so, writing her to accompany him, but she has since refused to live with him, and she sold the house in July, 1890, and left the city. He states that in” June, 1589, at the solicitation of his wife and relatives he conveyed the house to C. M. Watts, defendant's brother, to be held in trust for her. and subsequently conveyed it tw her, and although it was worth $10,000 she sold it for $8,500 and disposed of his furniture worth $1,500. a ‘Wants $10,000 Damages.
