The court decided that the action of the presiding officer of the Rushville city coun- cil im ordering that members present and not Voting should be so recorded, and be counted 8s part of s quorum, was proper, and that an ordinance passed by a quorum so constituted was valid) They also claim that the Practice of the English House of Commons is ia line with Speaker Reed’s ruling, and that none of the evils feared from the practice have shown themselves in that body. The demo- crats claim that in view of the American pre- cedents the change of practice, if it were to be made, should be made by the House itself and should be formulated in a rule, and should mot be accomplished by the Speaker alone. ‘They point out that the Speaker’s ruling that there may be a legal quorum without a quorum voting bas not been sustained by a quorum of she House, except of the kind constructed by the Speaker. They contend that the Speaker has devised a new variety of quorum, and has sustained his device only by the use of the de- vice itself, and are aggrieved thereat, And so the battle rages. The District experiences today a change in its Engineer Commissioner. Major Raymond is relieved aud Colonel Henry M. Robert takes his place. The retiring Commissioner in de- ciding between conflicting interests in the per- formance of the duties of his office has of course disappointed some and probably many persons, and he has received thecriticism upon some of bis acts which falls to the lot of a District Commissioner. But the general public will regret that he is to go. His report upon the overhead wires and methods of bury- ing them is a valuable contribution to the weapons with which the city fights for an important municipal reform, and in his deal- ings with the railroads, which have come to exercise a controlling and paralyzing influence upon many local officials, he has shown as cir- cumstances have developed it an intelligent public spirit and bold independence of corpo- rate influence. The community appreciates what he has done in these respects and his good work in general, and bopes that his man- tle will fall spon a worthy successor. ee New York's chances for the world’s fair de- pend on the slim prospect that the discordant leaders who have controlled the action of the two houses of the legislature will come to an agreement today. When she thinks more about it she will probably wonder why she ever tried for the site at all when such an admirable place as the national eapital was in the field, hoiding out advantages that are un- phallenged and unchallengeable. The capital of the;greatest country foanded in the grand Givision of the world discovered by Christopher Columbus is obviously the fittest place in which to commemorate the event of the dis- covery.
