The programme promises & charming entertainment. ——___—_ CHARGE OF LABCENY—Bvfore Justice Bates.— Upon the oath, &c.,of one Loutsa Hays thata hese had been felonionsly stolen from her,&c., & warrant was issued for the search of the prem- ises of Lou's Thelemann, on 12th street; aad on ‘Thursday last the said Thelemann appeared before Justice Bates upon the charge of steal. ing the hose, attended by his counsel. M. ‘Thompson, Esq., Mr. Wharton appearing for the prosecution. Mrs. Hays testified that some tUme previous she had authorized aman by the name of Charles Coleman to take the hose to the store of Mr. John Henney, on D, between 22th and 13th streets, a wholesale liquor mer- chant, and to leave it there for safe ing until she should call for it, and she knew he bad jest it there, &c.; and that she calied upon the defendant the day before his arrest and asked him for the hose, and that he said he had bought it from Coleman and paid for it, and that he would not give itup. John Fred- rich, a clerk for Henney at the time, testified that Coleman deposited the hose in Hen- ney's store some time previous for safe-keep- ing until called for, and that some time after- wards Coleman and the defendant went to Henney’s store, where the hose was, and that Coleman then Te sold the hose to the defendant for five dollars, and that on the next day the defendant sent for the hose, and that he sent it to him. counsel for T. proposed to show that ays and Coleman had been living and co- ing together as husband and wiie,and quo- ted 2 Esp., 637, Ballers N. P., 114, 1 Camp., 245, to show that such living, &c., Was presumptive evidence of marriage, so as to give Coleman the Fight to dispose of her personal property, &c., or atieast to warrant the defendant in sup- posing that he bad such right; and, further. more, that the law presumes the actual pos- sessor of personal property to be the legal and Tightfal owner thereof until the contrary ap- ears, and that in no pointof view had any larceny been committed in this case. There ‘was no larceny by the defendant, for he had bought the pr: Tly openly and above board, and inaregular business way, and under no cireumstances of suspicion whatever. And there was no larceny on the part of Colemaa, for be acquired the possession of the property lawfully, by and with the knowledge and con- sentof the prosecurtrix. according to her own showing, and even if he was not to be regarded as her husband, it was at mosta mere breach of trust, and not a larceny on his part, to have sold the property. Authorities were read in support of all these propositions. The Justice took ime to consider whether to hold the de- fendant for court or not. Ss CrnimyaL Court, Judge Wylic—On Satur- cay, George D. Bowman, indicted for the lar- ceny of two barrels of flour, was convicted and sentenced to one year in the Albany peniten- ary. Mr. Aiken for defense. Wm. Carroll, charged with the larceny of a wateh from Mrs. Catherine Quirk, was found guilty. Sentence suspended. Aiken for de- tense Ciara Goodman, as nall colored girl, indict for the larce of & quaauty of clothiag from Mrs. Margarit Sheehy, was convicted and sentenced to the Albany penitentiary for one year. Jobn Walker, convicted of the ny of gvods from Evan Haghes, to three reat Albany, and Charles Blue, convicted of the larceny of goods from A. M. Clark, to three years at Albany. Wm. Henry, a smal! colored boy, charged with larceny, was discharged. The petit jury was discharged and the Court adjourned to Wednesday, when it will hear and determine on motior~ tor new trial, aud close up the business of \. term. eR See SHootrxc Case 1x Mreper Bay.—Last nigbt, a colored man who has not been arrest- ed, went to Murder Bay and met w Jenny Sharp, colored, and made some remark to ner that aroused the anger of her lover, Simons, colored. mons called him to ac- count for it, and the stranger struck him. Si- mons was about to return the blow, when the stranger drew a pistol and fired, the ball en- tering Simons’ body near the navel. Jenny Sharp followed the stranger with a brick, and the stranger turned and fired at ber, but missed her, and then escaped. Dr. Russell was called to attend the wounded man, and probed the wound, but failed to find the ball, and pro- nounced the wound very dangerous. Simon: was placed in shack and tsken to his sister's residence, ou K, near 15th street, Roundsman ¥rankim, of the Second Ward, with a squad of officers, arrested a number of who Were witnesses of the affair, but they gave no clue by which the fugitive could be traced, and they were discharged this morning. When he arrived between 3d and 4% streets, the carriage came in contact with & wagon, and thereby broke off one of the carriage wheels. The swingle-tree also broke, d the horse, tbus freed from tbe carriage, kept om up tbe ayenue, and was caught at 7th street.
