Itappeared in evy- idence that the plaintiff rented the house on the corner of 7th and I streets east on the 25th of July, i564, but for no specified term of time, and thats few days afterwards he promised the defendant that he would not disturb him in the possession of the house for one year, &., but before the expiration of the year Repe.ti brought his action before Justice Call for the po=session of the house, but upon proof ot the promise of K.,as aforesaid, Justice Cull ren- dered judgment in favor of Carter, and after the expiration of the year the present action was brought. It also appeared in evidence that Carter had sublet the house and was not occupying it himself. The notice to quit had been regularly served upon Carter and not upom the sub-tenant in possession: and Repet- u's counsel quoted Taylor's landlord and ten- ant, sec. 491, 10 John’s, R. 270, 14 East, R. 234, vo show that “the landlord's notice to his ten- ant will enable him torecover the premises agaimst an under tenant, and that a lessor can- not give @ valid notice to a sub-lessee, or an under tepant to the original landlord, since there fs neither privity of estate or contract be- tween them.” he counsel for Carter argaed thatthe matter in issuein this suithad been decided in tavor of the defendant by Justice Cull, and could not again be inquired into b: this court. Crenningham was arrested by officer ©. L. Greer for the larceny of « pair of shoes from Isaac Rosenthal, 7th, between D and E streets. The pr was not re- covered, but the prisoner was sent to jail for court. Thos, J. Connor and Wm. H. Rebbins were arrested by officer Brewer for the larceny of about $l4 from an old lady named Jan+ Hob- bins. Connor was sent to jail for court, and Wm. Robbins was dismissed. Isaac Lambert was arrested by Sergeant —— for the iarceny of about $1°0 trom A. McDougal, a di-charged soldier of the V. R. «©, who was riding tm a back with the eecused nnd others. The prisoner was identified, and Justite Thompson sent him to jail for court. Subsequently John Adams, A. Lafontaine, and J. McLaughlin, were arrested by Sergeant Skippon and Roundsman Johnson, but as the complainant and witness resided in the 7th Ward, they were sent to the 7th Ward stution for trial, except MeLaughlin, who was dis- missed by Fudties Thompson. Robert Johnson was arrested by officer Tay- lor for the Iarceny of one dozen chickens, the property of C. W. Caldwell, a dealer in the Center Market. The chickens were recovered, and the prisoner was sent to jail for coart. ————— 9d Aw UNPAITHYUL SunstirvTE.—On the I6th instant, detectives Clarvoe and McDevitt ar- rested James Fleming alias Sugar Mouth, eol- ored, for the Inrceny of silk goods, &c., from the store of Max Lansburgh & Brother, 7th street. The prisoner was temporarily employ- ed in the store during the fliness of the regular porter. Atier the discovery of the loss it was Teported to the detectives, who instantly went in seareh of the goods. and found a portion in the honse of Martha Sewell, colored, where the prisoger was boarding. Yesterday, the pris- oner had a hearing before Superintendent Rich- ards, and the goods recovered were identified by Lansburgh & Brother as their Ss ‘The —— tuimitted the lerceny, and said sold two of the mantilias to Martha Sewell, to pay his bill. Maziha denied it, and accused the prisoner of stealing money from herson.
