L. Black was ejected from house No. 4(4%, Twelfth street, by Mr. E. W. W. Griffin, who claimed the right to eject, alleging that Mrs. Black had failed to comply with the terms of the lease. Mrs. Black engaged Mr. W. J Miller as counsel to make an effor: to restore her the possession. In the discharge of his a Mr. Mier used some remarks that in- 4 Mr. Gritiin to ciaim protection of law. Mr. Miller was arrested and required to give bail tor peace. As was stated in the Star, at the same time a warrant was issued upon the oath of E. W. W. Griffin, who charged that Mrs. Biack struck him and spit in his face; and the case was ruled for trial before Justice Clark at noon yesterday. At the hour appointed the partics appeared, Mr. Miller appearing as connsel for the defence. Edw. W. testified that Mrs Black spit dn his face on Sunday morning, and struck him on the breast Monday morning. Witness was in bis house, No. 40i% Twelfth street, and Mrs. Black was there. Witness went up stairs for Some erticle, and Mrs. Black met him and spit in his face. Witness went into the house and took possession on Saturday. Mrs. Black did not know witness was there until after he was in. He went up stairs to the parlor and told her that he wanted her to leave quietiy. Wit- kK possession by advice of Mr. Uter- counsel. examined by Mr. Miller:—Mrs. Black ordered witness out of the house three or four times, and witness also ordered her out. Wit- mess don’t recollect that on Monday she told him to ¢0 out, but previously she toid him that he had no authority to put her out. When Witness went there Saturday he was accom- panied by a distrain officer, Mr. Kelly, and Mr. Givevs, his clerk. When witness went on Mon to eject Mrs. Black, he was accom- panied by his brother, and by officer Voss, who he tock &s @ conservator ot the peace. Witness went in and ordered Mrs. Black out of the house. She tock possession on the 2; tember, 1563, under a lease till 2ist June, 1 She paid witness two months’ rent, and wit- ness put her ont for a breach of the covenant. W. S. Griffin testified that he was present when his brother attempted to put Mrs. Black outofthe house. Witness’ brother asked Mrs. Black six, eight, or ten times to leave the honse. She refused, and sat down in a chair. Wit- mess’s brother took hold of her, and took her down stairs. She resisted and kicked. Witness tock hold of her to prevent her from kicking his brother. After getting her down stairs, Witness is potsure if she went out herself, or if his brother put her out in the stree:. A. H. Voss, patrolman, testified that Mr. Grif- fin called upon bim on Monday last to go with him (Griffin) to his house, saying that a woman Wis there without right, and he (Griffin) was going to puther out, but feared a breach of peace might ensue. Mr. Griffin told witness that he had been to the police headquarters to see about it, and came after witness to go. Witness wert with him; Mr. Griffin went up gtairs to the door and knocked; Mrs. Black opened it: witness and Griffin went in; Griffin told Mrs. Black to go out; she said she would Dot, and sat down in a chair; Mr. Griffin took hold of her, and took her down stairs. There witness asked Mr. Griffin to let her go back and gether shaw] and bonnet. It was agreed io,and she went back, and again refused to come down. Mr. Griffin took hold of her, and ashortscufile ensued, in which witness did not see clearly what passed. The two brothers Griffin again took hold of her and pat her out. in the parlor, Mrs. Black raised a chair, and ‘witness then took hold of her, and told her not to de soin his presence, as he was there to preserve the peace. Justice Clark decided that the evidence showed that the defendant had a color of right in that house as tenant: and if there was breach of covenant it does not appear. The competition was spirited and the prices very large, as figures will show.
