The questions of public law presented in the Watrous case are of the very last importance in relation to our judicial system; and they should be met by Congress now, and prece- dents made for the future regulation of the judiciary. In this view we hope the case may be brought toa final trial. It is, we repeat, the first proceeding in the history of the Gov- ernment to impeach a Federal Judge for cor- ruption ; and in the decision of this case it will become necessary to define what is meant by ‘good behavior’’ as the constitutional ten- ure of the judicial office; as Judge Watrous’ ad- Yooates contend, if we understand them cor- rectly, that he is accountable only for offences in the nature of common crimes and felonies, and not for other misconduct. This is a question which involves important considerations of our system of government. It should be met now and in this very case. Again, it is understood from the defence made for Judge Watrous by a portion of the committee, that it will be contended that a Federal Judge cannot be impeached upon the ascertainment of what is commonly termed probable causes, but that it must be on the clear proof of guilt. Tus Paorosen Iupgac Brat JupGe For tHe Western District oF Texas.—Among the prominent topics continued from the last session of Congress, calling for a prompt disposition, is the impeachment case of the Hon. John C. Watrous, of Texas. It has excited considerable comments in the public press, which amount to a very genoral expres- aion of sentiment that it should be disposed of finally by Congress, acting, as it always should, in a spirit of justice aud for the public weal It constitutes an important precedent, it being the first proceeding to bring to trial a Federal Judge on open and direct charges of corruption and dishonesty. The particular facts of the case, too, are of such notorious and grave in- terest as to call for investigation; and on the whole, the question presented in the Watrous ease, appears to be not only one involving the settlement of important public issues of public law and of the practice of impeachment, but one of the personal guilt or innocence of the man of the most heinous crimes that were ever perpetrated or ever alleged to have been per- ‘petrated under color of a high Federal office. ia For a number of years, Judge Watrous’ ju- dicial conduct in Texas has been the subject of the most violent public complaints; the State and citizens of Texas and other States invoki 9 the only competent judicature in the country— that of Congress—not, indeed, to affirm the Judgment of guilt, but only to do the simple act of justice of trying the ease, once and forever, im the mode provided by the Constitution. We intimate no opinion of Judge Watrous or innocence in recommending the determina- tion of his case by a full and just trial. In either case, a trial is desirable ; and we think it due to the importance of the precedent, due to the long sustention of the charges made against the Judge, and especially due to Judge Watrous, if charges so notorious and so appa- rently sustained on preliminary investigations are really false, that tLe controversy should be determined by the final investigation and ver- ot the United States. He was popularly accused of having obtained the office with a view to speculating in land titles, and abetting a monstrous conspiracy of fraud on the public domain of Texas. These accusations assumed a definite and responsible shape. Resolutions were adopted by the State Logislature urgently requesting his resigna- tion. These appear to have been disregarded; while, as bis judicial career progressed, other acts of his were protested against; and specific charges of the grossest corruption were at last brought to the attention of Congress with a View to remove him violently. In the memorial addressed to the Thirty- fourth Congress, he was accused, on alleged doc- umentary evidence of the highest character, be- ing records of courts, &c., of betraying and de- frauding a suitor in his court; and he was also charged, on a full and apparently responsible statement of facts, with having used his court to advance a corrupt and concealed interest of his own in certain land suits, and with having as- sisted in the procurement of alleged illegal and forged testimony to fortify the claim of himself Prize of eleven equare Telegraph line to the Smithsonian Institution. A unanimous recom- mendation was made by the committee of that Congress for his impeachment; but it was not acted upon by the House. We have not indicated the opinion that the case should be fully and fairly tried by Con- gress from any Presumption of our own that such triai must result in his conviction We have no right to presume our slight acquaintance ease.
