Coleman} flayed the 1935 congress for “flag- rantly exceeding its lawful power” by its enaction. The act itself, he said, ‘was “grossly arbitrary, unreasonable and capricious.” He instructed the American States Public Service company, therefore, to treat the act as “invalid and of no effect.” Trustees Fought Opinion ‘Trustees of the company had con- tended compliance with provisions of the law would make their reorgan- ization plans impossible of comple- tion. They asked for instructions and sought an opinion as to its constitu- tionality. The case now is headed toward the United States circuit court of ap- peals. .A further appeal, from the decision of that court, would send it to the supreme court.
