In the hope of finding some legal way of broadening the fuel oil regu Tations so as to permit, with certain sufety restrictions, the use of oil fuel tn apartment houses, hotels and tene- Ment houses, a complete set of ques tions was presented to the City's Law Department yesterday for an opinion ‘Tne questions asked were formu ated by representatives of the Fire Department, Tenement House De partment, Board of Standards and the several Superintendents of the Build ing Departments, in all boroughs. The questionnaire to the Corporation Counsel was the result of a confer- ence held in the office of Tenement House Commissioner Frank Mann Under the existing regulations the Question of the use of oll fuel in @welling houses is one which at least three city departments are in con- fist and in order to clarify the exist- ing rules the legal aid of the city has Deen asked. Recently, In an apartment house in Brooklyn, where the owners installed ofl burners and storage tanks, on the authority of the Tenement House De- partment, the Fire Department later stepped in and ordered the use of the fuel oil discontinued on the ground that an ordinance expressly forbids such a practice as creating a hazard- ous condition, and endangering life and property. On the other hand the Tenement House Department has complete jur- isdiction over tenement houses. Just where the Fire Department stands in the matter of fuel oil storage and use in tenement houses is-one of the questions to be answered by the Law Department. .
