‘VICE CASE CONVICTIONS SET ASIDE ON GROUND JUDGE ACTED UNFARLY Alleged Lessees of 118 Dis- orderly Houses Are to Be Freed on Bail. The conviction of Joseph Shenk and William Glasser, declared by District Attorney Swann to be the lessees of 118 disorderly houses, was to-day set aside by Supreme Court Justice Giegerich, who granted Attorney Abraham Levy's application for a certificate of reasonable doubt. The men were sentenced to a year on Blackwell's Island on a charge of maintaining a disorderly house at No. 62 West One Hundred and Seventh Street. Because of the wealth of the two men and the large number of apart- ments under their control, the Dis- trict Attorney considered the convic on @ great victory. In tho past, Mr Swann said, it was almost impossible to convict lessees of disorderly houses, | but an easy matter to send the in- matos to jail, | In his decision to-day, Justice Glegerich finds there is a question in his mind as to whether the attitude of Judge Joseph Mulqueen of General Sessions, and his manner toward the defendants at the trial was impartial, as it should have been. Counsel for Shenk and Glasser charged one-half of the trial eessions were taken up by Judge Mulqueen’s comments and | questions, and that frequently he} stopped to “ridicule, criticise and dis- credit witnesses called in behalf of the convicted men.” | Both defendants are in jail, but Jus- tice Glegerich’s decision admits them to bai pending their appeal to the Appellate Division lis | FLAGMAN AND ENGINEER BLAMED FOR N.
