BORDEN HELD ON HOMICIDE CHARGE Magistrate Insists on Prosécution for Auto Killing and Beratés Policeman, Dr. Matthew 8, Borden of No, 316 West Seventy-ninth street, son of the late M. C. D. Borden, multi-millionatre textile manufacturer, whose auto ran down and killed Mounted Policeman John Mee in Flushing early yesterday Morning, was brought before Magis- trate Fitch in Flushing Police Court to-day charged with violating a city ordinance by running his auto with the muffler cut out. ‘When Mounted Policeman Abraham Newman told the charge, the Magis- trate grew indignant. He declared it was outrageous simply to charge a man who had killed another man with violating an ordinance. New- man explained that “it was believed the accident was unavoidable. “Why, when a train kills a man,” retorted the Magistrate, sarcastically, “the engineer always is arrested. This man was driving fast and he killéd a man, I don't understand police méth- ods in this case. I order you to make out @ charge of homicide against this man.” This was done and Dr. Borden was arraigned on the homicide charge.
