Fleischer, demanded from Conklin the return of the check. Conklin declined to return the check or its equivalent and told the attor- mey that the affairs of Mi. Conti are @uch that he will not be able for time to state whether Mr. Conti's assets are in excess of his @ebts. He usked Mr. Fleischer to ‘wait until Conti's business is straight- ened out.
