STREET LH ARIST” NSN $3,000 000 SU holders of Absorbed. Rival Barred From Action by Court Decision. "An equity sult, brought in the United States District Court under the Sher- fan Anti-Trust law. against the ¢0-| called “Street Lighting Trust” to recover triple damages for the alleged wrecking fh 1910 of the Consolidated Btreet Light- ing Company, « $1,000,000 corporation, ‘Was diemiesed to-day in a decision by | Jeage Coxe. ' ‘The gutt wee brought by Wiltam M. Wietemann, a stockholder of the Con-| aatidated Gtreet Lighting Company, on | Sehalf of himself and other stockhold- | a. The defendants were the United | @ee Improvement Company, the United | Laghting and Heating Company, the Welsbach Street Lighting Company of America, the Consolidated Gtreet Light- fug Company, William Findlay Brown, | Arthur E. Shew, Randall Morwan, Sam- yet T. Bodine and Thomas Dolan. ‘Mr. Fieitmann asked for damages aggregating $3,000,000. His complaint charged that the defendants (other than the Consolidated Co,, forming the alleged “lighting = trus' rior to 1906, entered into a conspiracy to con- tfol the Susiness of street lighting and @otain coniracts for municipal lighting supplies and apparatus throughout the ed States. The complaint charged the conspiracy was put into e: @eution by the organization of oth epncerns, ostensibly competing com- | @entes, but under the control of the detendants. The complaint alleged that the de- findante, by fraud, acquired a majority oR stock of the Consolidated Lighting | Company, and placed their own men im control of the corporation, succeeding ig wrecking the company in 1910. Tn thi cision Judge Coxe held that the dill in equity failed to state f action; that to recover thr damages vannot be maintained, the Sherman Anti-T: act, by a single minority shareholder of the corporation rectors and majority stock- | t. (tial dens asa SHOT AS HE PASSES DOOR; ASSAILANT ESCAPES. Salesman May Die From Wound— Police Believe He Was At- tacked by Mistake. ‘Benjamin Eckstein, a salesman of No 15 Tompkins avenue, was shot in the groin and in the left elbow early this | morning when he was passing the Forty-seventh Regiment Armory on Marcy avenue, Brooklyn. Eckstein dropped, but remained conscious long @@ough to see a man run from the door of a tenement opposite and turn into Lynch street. Policeman Behnk of the Clymer street station also saw the man running away and chased him i-r a block until he disappeared into the night. Eckstein was taken to the Bastern District Hospital by Ambulance Surgeon 1 pay who said that the wound in tl groin might cost him his life. When he recovered consciousness Eckstein told tie police he could give no description of t® man who shot him, but was sure he hed never seen the man before. ‘The police believe that the man who fived the shots mistook Eckstein for an enemy for whom he had been lying in wait.
