It is thought now that after the trials of Jett and White in Harrison County the cases of other assaseins who are known here and who have never been arrested will be taken up with some show of justice on a change of venue. Among the cases cited is that of the late Dr. Cox, whose friends refused to secure witnesses for any jury in Breathitt | County that was selected under the pres- ent regime. The next case on the docket here is that of Curtis Jett for killing the town marshal, James Cockrill, but it will be postponed until after the trials at Cyn- thiana, and many believe now that there will be no need of trying Jett on more than one of the cases standing against him. Colonel Williams is night conferring with the Governor re- garding the withdrawal of the troops. It 1s understood that he advised the Gov- ernor that no number of troops could stop the lurking firebugs or the hidden as- sassing, but that at least one company should be retained in Jackson as long as Provost Marshal Longmire was kept in charge of the town. The troops that escorted Jett and White to Lexington this evening will not return. There is still much apprehension in the community for the future and many here share in the movement in different parts of Kentucky at Frankfort to- to have Breathitt County parceled out for annexation to other counties, al- though it might depreciate local valua- tions after Jackson a county seat. Some hold that in the mere loss of the so-called “Courthouse ring” the town lost its prestige as would gain much more than it would lose, | It is claimed that all the feud troubles that have aficted the county originated in contasts for local offices and afterward extended into professional, busdiness an social offices. Tt 48 consideréd that Prosecuting Attor. ney Byrd is not safe here and he went to ‘Winchestar to-night. Mr. Bailey, fore- man. Grenfi Jury which indicted Jett and White, has aleo asked for mili- tary protection. He savs he has received hinte of trouble in store for him. LEXINGTON, Ky., June 19.—When Jett and White arrived at Lexington to-night they were taken rapidly to the jail by the State guards and placed in separate stes] cages on the third-floor of the jail, despite. their request to be placed to- gether. Jett had been exceedingly unruly and insulting all afternoon, evidently be- {ng under the influence of liquor. County Judge James Hargis of Breat- hitt-came down on the train with Jett and White. Later Hargis -visited prisoners at the jail. e VICTIMS OF THE FLOOD BARELY ESCAPE MURDER ST. LOUIS, June 19.—Lying unconscious and with gaping wounds in their heads, Mrs. Samuel Bailey and her son Gus and daughter Eliza were found early to-day along the tracks of the Big Four rallroad near East Alton, Il tempt to murder them had been made, and. it is beHeved they cannot recover. The assailant or the reason for the prob- able murders is not known. The victims are in very humble circum- stances, having been driven from their home in the river bottom& near Edst Al- ton by the flood. L e e R furnace. Rodriques in turn gave the or- der to Thomas, who was working at his side. Thomas was surly and answered in an impudent manner. -The two ex- changed hot words and in a flash dirk knives were drawn. Before workmen could interfere Thomas' blade had sunk thrice into the body of his an- tagonist in the rignt hip, in the abdomen and just above the navel. Rodriques feil while attempting to jab his knife into Thomas’ neck. Rodriques was taken to his home. His wounds are sald to be fatal. Both men are married. Rodriques has several children. He has a brother living in Oak- land or San Francisco. Rodriques told Constable Williams that he did not want to swear to a complaint against Thomas and consequently .po arrest has been made. ———— A Guaranteed Cure for Piles. Mr. Knox continues: |, The right of a pdrty in ordinary litigation | |t a release of property from attachment upon | 8iving a bond for indemnity is fundamental. | It manifestly applies with greater force and reason in a case affecting the Government than | where the interests of private litigation alone are involved. The statute of 18 enables the Government, although not a party, nor in gen- eral subject to be made such, to infervene with- | out prejudice and invoke that doctrine. The nature and necessities of the subject, | the sovereign claims and the interest, the ob- Ject to be gained, in the words of the statute | and its reservations, all convince me beyond | doubt that the stipulation to be entered into is an engagement on behalf of the United | States, which shall be addressed to and filed with the particular court under proper reserve | of submissfon to the jurisdiction, whereupon discharge of the property as a matter of course would follow and adverse ciaimants would have | the opportunity of establishing, in accordance with the law, their respective claims against | the bond of indemnity thus provided. In concluding his opinion the Attorney | General says: Oné further point remains to be considered The letter of the Secre of the Navy re. quests to be authorized to employ if necessary | the military forces of the Government at his disposition for the execution of his orders in | the premises. 1 am loth to belleve that occa- | sion for such execution of the Federal powers | will arise, being confident that any claim to interferg with the national rights under the judiclal authority of the State of Virginia w be promptly disposed of and denied by the Chancery Court For this reason I shall defer | answering that question. { The Cabinet, after considering this opin- fon, unanimously decided that the Go ernment case was sound and the pro- gramme outlined yesterday by Mr. Moody | | should be pursued. An effort will be | made to launch the boat next Monday if | conditions permit. It is information will be conveyved to the Vir- | | ginla Justice who granted the injunction in this case that he has exceeded his! proper function and it is expected that | he will withdraw from what the Attor- | ney General and the President regard as | an- untenable position, thus avoiding any clash.
