Coleman, a prominent young dentist, with offices in the Vendome build- ing, 1104 Market street, has disappeared, and .is parents and friends can obtain no trace of his whereabours. Coleman occupied offices with Dr. C. L. Z egler, another dentist in 1the same build- ing, and a week ago last Thursday Cole- min’srent became due. Zregler kept pressing him for the money, and on Fridav afiernoon the young den- tist assured Ziegler that he would make payment the same afiernoon, but he did not return until about 9 o’clock Saturday morning, when he found Ziezler had locked up bis (Coleman’s) office, which contained the latter's instruments, etc., snd wien Coleman applied for the keys Ziegler refused to give them up until the rent was paid. Coleman was last seen on the afternoon of Saturday, and since that time his parents and friends have been unable to locate him. The parents entertain the fear that he has either met with foul play or has com- mitted suicide. Ziegler and Coleman had some words about taking one another's patients, and this is said to be the main cause of the difiiculties between the two dentists, The police are investigating the case. Coleman lived with his parents on De- visadero sireet and was very popular, hay- ing & large number of friends. UNTANGLING LEGAL KNOTS, A Congressional Bill That Will Apply to Murder Cases. The recent legal complications and tangles growing out of the cases of Dur- rant, Ebanks, Allender and others has caused some of the legal fraternity of this citv to take steps looking to the straight- eniag oat of a few of the present Jaws that make such things possible. Ex-Judge Rovert Ferral and a number of other law- vers have appiied to Congressman James | G. Maguire to present to Congress a bili tuat they will frame, the object of which is to prevent frivolous applications to the United States Su;reme Court on habeas corpus. As the law stands now an appeal can be taken from the refusal of a United States Judge to award a writ of habeas corpus, | but there is no appeal to the Supreme | Court of the United States from the final disposition of a writ after issne. In sucn cases the appeal iles to the United States Circuit Court of Appeals. Mr. Ferral says there is a short cut to the matter, but ihat the Judges do not always take that way of doing busine s His ides is that in these annoying murder habeas corpus cases the Judge shonld issue the writ and order and dispose of the case by remanding the petitioner and thus dis- posing of the matter and letting the case take 1ts regular course. The bill providing for the straigxhtening out ot these laws 18 now in course of preparation and will be delivered to Con- gressman Maguire very soon. —————— A Dangerous Dive Sunday at 4 o’clock in the afternoon and again in the evening Otto Schulte will dive from a pole seventy-five feet high intoa tank of water three fect deep at the Chutes, A DOCK CATSED THE TROTBLE, D'Aubertin, the Sculptor, Has an Experience With the Police, Guardians of the Peace Refuse to Put the Bird Out of Misery. The Chief, a Sergeant and a Patrol- man Finally Figure in the Episode. D’Aubestin, the well-known sculptor, caused the police force, from Chief to pa- trolman, no end of worriment the other evening, and all because of one poor lame duck. The artist is naturally a tender- hearted man, and his sympathies were aroused to a high pitch when, while pass- ing down Jones street, between Ellig and O'Farrell, with a young lady, he discoy- ered a duck that had been hurt by a cak lying in the roadway. He promptly telephoned to the Society for the Prevention of Cruelty 1o Animals and Secretary Ho'brook told him to tell his tronbles 10 a policeman. The sculptor found the guardian of the peace and im- mediately started to pour forth his tale of woe. The officer asked him who gave him permission to speak to him in the manner he did. Then the burly guardian of the peace was told that Secretary Hol- brook of the society was the one who rece ommended kim to his mercy. The police- man informed him in freezing terms that he recognized no one’s authority but his Chief’s. Again D’ Aubertin used the “phoane,”and this time poured his tale into the patient ears of Chief Lees. In patbetic tones he told how the poor littie duck was just pining to be killed, etc.. etc. Forthwith Mr. Lees told the molder of - clay to tell the policeman to look into the matter. Endowed with this power he again sought tbe offic'r, and this time commanded that awe-inspiring person to shoot the duck. Still the policeman was obstinate. He saw visions of an irate owner of the bird declaring yengeance over its lifeless form. He saw fabulous sums being ded: cted from his salary to pay the damiges the owner of the ieathered cre: ture would claim. D’ Aubertin despaired not, however, and againu paid a nickel to the telenhone com- pany, and tried ouce more to persuade the Chief ot Police to end the creatare’s sul- ferings. His tale was so pathetic and he Wwas so persisient Lhai the Chief could withstand his pleadings no longer. He immediately dispatched a sergeant to the scene of the rouble. By the time he arrived quite a crowd had congregated, and the sergeant oniy being informed before he left the staiion that there was liable to be some shooting, and not knowing what tne cause of tue trouble was, canie all prepared, thinkin : be had nothing less than some desperaia robver to contend with. He was taken back, however, when ha saw that the cau-e o the disturbance was only a poor little uuck that was ripe to die and on which the sculptor bad taken ity. v The sergeant was prompt in action, and in a few moments he had the poor little innocent caught, and, drawing it into a near-oy a'ley, vended it suffering. Then D’Auvertin geparted in peace THE DURRANT TANGLE, Atkomeys Criticize the Action of dudge Bahrs in Imposing Sentence. Should Have Waited for the Mandate, Rumors of Ex-Mayor Sutro's Interest. Criticism, gentle yet pregnant wiih meaning, can be heard in many of the offices and lobbies where lawyers are u-ed to congregate on the action and what is termed ‘“‘undue haste” of District Attor- ney Barnes and Judge Bahrs in sentence ing W. H. T. Durrant to hang beiore the mandate had been received from the Supreme Cour: of the United States. The points upon which the lawyers base their criticism are several iIn number. Ore of the principal points of whick but little meniion has been made Is th fact that there is at present in the hands of the State Supreme Court an appeal from tie judgment of Judge Bahrs in imposing what the attorneys for the de- fense choose to call a double sentence. The Supreme Court has not as yet decided the appeal, it being argued before that tribunal the day prior to the sentence be- ing imposed on Durrant for the secona time by Judge Bahrs. It is said that the Superior Court was cognizant of the fact that the appeal had not yet been decided, but for some nntold reason failed to take judicial knowledge of the fact. Another point of discussion is regarding the fact that the mandate had not arrived from the Supreme Court of the United States. The attorneys for the prosecution cited in Tehalf of their case the decision renderea in the celeorated Ju:iro case. It is claimed that this case appliesin but immaterial pointsto the case in isu-e, and that the court that sentenced the prisoner made an erroneous interpretation of tnat finding. As soon as proof can be made that the mandate or remittitur has come down from the United States Supreme Court 1t is said that tne appeal in the State court can be dismissed on moiion of the Attorney-General if that tribunal sees fit. In this way the hitherto supposed endless chain wiil be severed and the Superior Court may set another day for the carry- ing out of the judgment of eath. In the event Durrant had been hanged last Friday, and later the Supreme Court bad fournd that the defendant’s appeal had merit and decided that the judgment of the Superior Court was void, an ap- paliing tangle wouid result. In connection with the case ths story of ex-Mayor Sutro’s interest in the mus- derer again comes up. The ex-Mayor and his frienas again vehemently deny the rumor that he in any way assisted the defendant financially or otherw e, and are becominz much ‘annoyea over the re- peated siatements to the contrary. ——— Printers Out for a Waik.
