The supervising inspector recalls the circumstances of the case, and also says the local board entertained the ovinion that prompt action referring to confining the water in the forehold by shoving down hatches seems to have been | reached without asking Captain Thomas or other witnesses as to the feasibility of such a proceeding under the existing cir- cuinstances. Second—The local boards are empowered and should be competent to hear the testimony in any case that may come before them—sifting the evidence and deciding the case on its own merits; hence, they were in no way justified in calling in s théy did, for the purpose of getting expert testimony, United States Li- censed Master Pilot David Wallace, or United | States Licensed Pilot Benjumin Craig, both of the Topeks, and known to be compe- tent navigators in Alaskan waters; but neither knew anything of tho ¢:se at bar other than from hearsav. If their evidence cou.d be con- sidered by the local board 1t was an error t0 Dpermit them to be present, as they were, dur- ing the taking of tbe testimony of Captain Thomas, and at the same time enter into dis- cussions with the local board and the captain, who would have Leen justified in requesting that their evidence should have been stricken outas irrelevant and immaterial, or else to have demanded & new trial. Caplain Toomes as United States licensed master was answerable 1o the officers of the steam vessel inspection service for any violation on his vartof the steamboat laws while in command of an American vessel (steam) in any waler. Section 4401, United Staies Revised Statutes, provides 11 specific terms that steam vessels sailing under register shall not be required to carry pilots licensed by the inspectors of eamboats. Vide department decision 665, page 303 ol the manual, fourth para- graph. Fourth—The Mexico wss sailing uncer reg- isier, and her master Or owners iy erefore were not wblizated under the law to employ & United s licenscd piot in Alaskan waters in his official capacity. It maiters not if there be 1o pilots licensed by tue territoriul officia.s; | bence, I hold that neither Captain Thom ss nor Conncll could legally be employed as United States licensed pilots on that vessel, nor were they 8s such under the circumstances subject to toe laws, rules and r-gulniions governing the steam vessel inspection service, even though the Mexico had been wrecked in Alas- kan waters; but ss the local voard entertained a different opinion they proceeded in a singu- Iar manner to punish Captain Thomas and Connell by giving the latter far the lighter punishment. As he, and not Captain Thomas, was unquestionably solely responsible for the ioss of tne Mexico; hence his, aid not Captain Thomas', licen<e should have been revoked by the jocal board had it the authority. Fifth—As the findings of the lower court as to the responsibiiity for the loss of the Mexjco are eutirely erroncous, therefore, for reasons above given, I wust decree that said findings be set aside, and it is 50 ordcred.
