10 THE SAN FRANCISCO CALL, FRIDAY ST PO EPTEMBER 17, 1897 LABOR UNIONS ARE AROUSED Congressman Maguire Takes a Hand in the Kelso Case. He Will Present Authorities on the Subject This Afternoon, If the Law Is Defective He Will Move to Bave it Amended in Congress. Labor organizations in this State are taking a lively interest in the proceedings in the cc8c of the United States vs. John Kelso, arrested by the United States Mar- ehal for wo hours per day on the excavation of the Postoflice site. United States Commissioner Heacock was to have rendered his decision yester- day afternoon to the effect that Kelso could not be held because he neither a contractor nor a sub-contracior on the work, the parties being the San Francisco 3ridge Company as the contractor and the Jobn Kelso Company as the sub-con- tractor. The opinion would have been to the effect also that a corporation could not be hela or punished for a misiemeanor under the Federal statute, which provides that officials of the Government or con- tractors or sub-contractors are guilty of a misdemeanor and punishable by a fine of $1000 and imprisonment for six months when they order or permit their employes to work more than eight hours per d In this case the John Kelso Company | was the sub-contractor, not John Kelso indiviaually Harry Saunders, who missioned by the San Council to look after th at the office oi Unitea States Attorney Yoote with Congressman Maguire. He reiterated the fact as to his baving grave doubts as to whether any consiruction of the statute would Teach the defendants under the facts, it baving been shown that che sub-contractor was the John Keiso Company and not John Keiso, the individual. “‘We cannot extend the criminal law be- | vond the letter, however much we may desire to do so,”’ he added. *‘‘The proof shows that there was a foreman named Gallagher, who directed the work, and that he was in the employment of a cor- poration. Mr. contractor or the sub-contractor than was Mr. Gallagher.” The matier was thereupon postponed until 2 o’clock this afternoon. RETURNED TO THE CITY. Thomas M. McFariane, Wanted for Embezzlement, Was Foreman of the Curtis Jury. Thomas M. McFarlane, for whose ar- rest on the charge of embezzling $189 from the California Undertaking Company a warrant was issued Wednesday, was foreman of the jury that found M. B. Curtis, the actor, not guilty of the murder of Policeman Grant on September 11, 1891. Atter the verdict was rendered ihere was talk of bribery as the «vidence was conclusive against Curtis, but nothing could be proved. McFarlane left the city shortly after- ward, and a report came back that in September, 1893, he had joined Curtis’ company at Los Angeles as manager. Later it was reported that he was man- againg Curtis’ hotel at Austin, Tex. J. W. Nash of the Undertaking Com- pany learned that he returned to the city a few days since, representing him- self to be agent for a Virginia tobacco firm, and he swore out the warrant for his arrest Wednesday.
