ECHO OF POSTOFFICE FIGHT Litigation Over O'Neill Newspaper and Some Notes De Reaches as County. Out at O'Nelll, Neb., there was a strenu- ous postoffice fight 1n 1898, and now it has an echo in the district court for Douslas county. Stephan J. Weeks, Robert R. Dickson, Daniel A. Doyle, Job J. King and Jesse B. Mellor sued the State Bank of ©O'Nelll, which has since become the prop- erty of G. W. Wattles and had its papers brought Eers, and John McHugh, its former cashier. Ellick, for the plaintiffs, maintained that it was suable wherever it aid business, and the judge took the arguments under consideration The story told in the petition indicates that the transactions were hasty ones made during the fight between Clyde King and Dan H. Cronin, partners in the publication of the O'Neill Frontier, to secure the post- office. The plaintiffs are King’s friends, and they bought from the State bank at O'Nelll an undivided one-half interest in the equip- ment of the Frontier plant, which Cashier McHugh 1s alleged to have stated that the bank owned, and also two notes executed by King and Cronin on December 13, 1895, and due January 20, 1896, for a total of about $1,000, against which paper McHugh s al- leged to have stated there was no defense by the firm of King & Cronin, and on which there had been paid nothing but interest. By mgking this purchase, it is sald, King's friends hoped to gain control of the plant and swing its policy to King's interests They gained possession of the plant in April, 1898, placing in charge their trustee, C. C. Millard, but five days later Cronin sccured it with a writ of replevin, and when the case got into district court the follow- ing March he secured final judgment and proved, it i alleged, that he owed on the notes only $165 and that the bank had sold its interests in the plant to him long before the deal with the plaintiffs in the present cago.
