The verdict which condemned him was today set aside and his | case remanded for o new trial. Coughlin will now, in all probability, go free, bec it will be practically impossible to cony him again The witness, Patrick Dinan, who swor that Coughlin hired from his livery stable the white horse which carried Cronin aw to his death, died many months ago. His | evidence was the main thing which led the Jury to declare that Coughlin was guilty of conspiracy to murder Three of the four men who stood trial with Coughlin—John F. Beggs, Patrick O'Sullivan and Martin Burk are dead Kunze was to all intents and purposes ac quitted and cannot be tried again. Withall his | alleged companions in the conspiracy out of | the way the state's attorney declaves he can | hardly convict one man of conspiracy when | direct charge of murder was not proven | inst Coughlin in the first 1. This will probably end the legal ¢f ter of the most | sensational murder case the world has ever known The rever. ine lis based principally on the ibility of Boutecou and Clark, jurors e Justics shows by the examination o tnese two witnesses that they we ju- diced when summoned; th ~ they had ! formed opinions, and that the court and at- | torneys were, to all ances, grossly | careloss. The two jurors were brought into | court on a spe venire specially ap- | pointed by the trial court for the purpose. | At the time they we lled and examined as jurors, Coughlin had exhausted the num- | berof peremptory challenges allowed by law | and could do no move than aver his objec- | tions to the citation of the two men jurors. When Boutecou was examined by the counsel for the defense he testified he had read newspaper accounts of the crime | and had an opinion as to the guilt of Cough- | lin, Burke and O'Sullivan, but that his | opinion would not prevent him from being an impartial juror. Boutecou testified that he entertained a | strong prejudice against the Clan-na-C and would refuse to believe them under oath and most ot the witnesses were members of that body. | Clark testified he had an opinion as to the | guilt of the acevsed, but he could render an | impartial verdict. He admitted that he had | frequently expressed an ovinion as to the guilt of the accused an | said that he enter- tained a prejudice against the Clan-na-Gael The supreme court de res that the . fendant had a right to a fair and impartial trial, and it was evident that he could not have had such a trial when two of the men who condemned him bad admitted before the trial that they were prejudice him and against the men who g of the testimony introduced in his b Two of the justices, Schofield and Ma- gruder, dissented Jouier, TIL.
