For a long time the meeting was uneventful, and then the Prospect Hill cemetery becamo the subject of discussion, At the last meoting of tho council the Cometory assoclation applied for permission to enlargo tho burial grounds by adding a strip of land on the south and another on tho enst. . 'I'ho council voted agninst any enlavye- ment of the cemetery, and the city attorney was Instructed to draft an orainance prohib- iting any furthor enlargement, City Attornoy Connell last night reported that it was not any enlargement, but was simply to fence in, improvo and sell burial lots frem the two strips. A tavtion was made to accept the report of the attorney, but four members were on their feet 1o protest. Mr. McLearic said that tho city attorney should have oboyed tho fnstructions of tho coupeil and reported back the ordinauce as requested, Mr. Howell sald that it was simply a move to enlarge the cemotery. Tho title to the two strips was in tuo Byron Reed ostate, and the city attorney could offer uo excusé for not reporting the ordinanco, Mr. Munro moved that tho papers be re- ferred back to the cily attornoy, and that he report the ordinance es instruted. Thought 1t Coutd Not Be Enforced, Mr. Elsisser said that the motion was being engineored by the Forest Lawn Cemo- tery ussociation, and was for tho purpose of crushing out of existenca the Prospect Hiil Cemotery association. The city could pass the ordinance, he said, but it could not be en- forced. Mr. Prince replied that if it was any scnemo |t was the sehomo of residents of the city, living noar the cemetery who had tired of drinking tho water that had passed over the dead bodies buricd there. Mr. McLoario protested against Mr. El- sasser stating that it was a_scheme upon the part of the Forest Luwn peoplo. He pro- posed to first protect the living and the dead aftorwards. 1f thoro was any #chome 1t was upon tho part of the Prospect Hill people to enlarge their grounds and sell lots for specu- lation. City Attorney Connell said that it tho strips were within the boundaries of tho old cometery and a portion of 1t. tho council could not pass an ordinance that could e enforced, but if thay were outside of such boundaries the city could control the grounds. Mr. McLoarie said that Byron Reed never deeded the strips to the cemetery nssocia- tion. It 1s re- ported today that Gity Attorney Connell is of the opinion that the city has no right to interfere in the mattor; thac there is no legal obstacle to the jcation of the strip to the cemetery association.
