Mr. J.C Root of Lyons, Ia., was the first witness placed on the stand in the case of D, 8. Maltby agalust the Modern Woodmen ves- terday morning in the Uuited States court. Ho related the fact thet he was head consul for the order from 1584 until November, 1500, He said that it wus very diflicult in the early history of the order to get solicitors, bocauso thoy could not make the business pay. Heo decided to offer special inducements and with consent of the advisory board ke saia said he made a contract with D. S. Maltby whoroby it was agreed that the said Maltby should receivo 10 per cent of the goneral funds of the order in addition 1o the recular commission, This contract was draws for tho term of ten years. Ho also mude a similar coutract with 'H. O, Hen derson. ‘These contracts were kept on the part of tho order until February, 1801, when the uew management decidéd, after paying Maltby and Henderson the large honuses that foll to them every month from Novem- ber to Fehruary, that the contracts were fraudulent ' and should be set aside. The question to be decided in this case is whether ornot the contracts were lewal and binding, 1oot claiins he had a legal right to make such a contract, and that Maltoy is entitlea to the mouey due bim under such, contract. The present management claims that the con- traots were illegal ana fraudulent. ‘The caso will probably be closed Monday. B A very smull pili, buva very good one.
