The judgment was presented to L. Kinnehan, the city treasurer, but acting on the advico of City Attorney Stewart, he re- fused to pay it. The ground uvon which the city attorney guve the advice, was that the justice, beiug east of tho west line of rauge 40, which is the boundury line between the Council Bluffs and Avocs judicial districts, had no jumsdiction over parties west of the line. Jdudge Mt rendering his deci the division of the county in judicial districts had reference only to the dgtrict courts, so that t Justices of the peace still had their jurisdietion in ull parts of the county, as b fore the luw establishing the court at Avocs was passed. e Hosiery, tbe Boston store hosiery and un- derwear departments are second to none in the west, they carry the finest fast black hosie in the world, a” small word with a big meati- ing, but nevertheless true. Peregoy aud S. B. Wadsworth were all there, and the tim was all taken up, as the time generally is when these well Kkuown worthies get together. The delibera- tions were almost entirely with reference to the improvements which it is expected o- make upon Fairmount _park during the pres ent season. There is about #4,000 1n the park fund and it is_intended to spend the entire sum on this park. he main trouble with Fairmount has al ways been that the roads were so decp as to renaer fugress and egress equally diffieult, and as tor driving, after one gets inside it was far from being us pleasant s a pleasure drive ought to be. Near the lead of Park avenue a twenty-five-foot cut is f be made, 50 that iustead of ascending the steep hill that1s at the head of this avenue, carriages can leave the road, turn to the left and reach the top of the hill by w grade of about six feet to the hundred. Another job of grading is to be done in_the southeast purt of the park, leading by a similar easy grade from the top of the east ridge to tho valley below, coming out near the band stand. Starting from the northwest corner of the park, a roud is to ve luid out from the top of the lookout down the cast side of the hill, leading to the cut on the southwest corner. After passing outside the purk the road will be continued until it reaches High street, Thus forming a means of egress from the park without going back the same way one came, or descendiug au almost indescendible hill. These improvements will be appreciated at thei value by all who have ever tried to enjoy a ride through the park, Nearly 2,000 New Carriages. It is understood that the president will give ¢onsideration to the various propositions and plans desigoed to strengthen the agreement and put the organ- ization on a safer fcoting. There seems to be uo doubt that Jay Gould will make another effort to secure the adoption of his pet scheme of establishing joint agencies. In fact, it is the geueral opinion that unless something of this kind is done there will be no further use in trying to keep the association alive, s there is no excuse of its egistence in its presont form. The be- lief no longer prevails that the Missouri Pa cific will be disciplined for reducing the sugar rate in violation of its agreement. The prediction of such men as Marvin Hughity and other officials that the meeting will be an harmonious one indicates that the compet- itors of the Missouri Pacific have covled down and will do notning to rufle Mr. Gould's feathers. WESTERN PASSENGER TROUBLES, The question of abolishing unlimited tick- ets was considered at the meeting of the Western Passenger association today but it was finally decided to postpone action on tho subject until the June meeting. "This course was made necessary by the unsettled condi- tion of affairs growing out of the Alton boy- cott. General Passenger Agent Charleton of the Alton obtaiued the consent of the asso- ciation to make a rate of one fare for the round trip for the farmers' alliance men who are to attend the national union conference in Cincinnati this month. Kaxsas City, Mo, May ‘The farmers’ alliance has at last received tardy justice from the Western Passenger association, which today passed a resolution authorizing u one-fare rate from Kansas v and other Missouri river points toCincinnati aud re- turn. It will be remembered that the first application for a one fare rate for the Cin- cinnati ‘alliance meeting was voted down The Chicago & Alton then asked for a reconsideration on the basis of a fare and one-third, which was also voted down. Nothing daunted, however, the gen- eral passenger agent of the Alton rcai had the question reopened at today’s meeting of the Western Passenger association and by unanswerable argument in favor of the original proposition for a one-fare rate finally secured the reduction in the face of stubborn opposition on the part of some of the western lines. Only one important line was not represented at the mecting, but that road’s vote can be counted on in its favor. Denver & Rio Grande Earnings.
