It was also decided that the defendant was still lawfully possessed of & licenso and was not, therefore guilty of the offense charged, T'his decision is virtually to the effect that all cases of violation of the Sunday closing clause must be prosecuted before the police magistrate, and no licenses can be revoked on that ground unless the defendantis found guilty by the proverly constituted court.
