MoComas Josiah Rogers and Robort P. Drap Otoo county, Nobe for the sum of §5,002.02 and interest'from March 7, 1858, Duke W. Simpson, it will bo remembered by the readers of Tie Bee, was the embez- #ling treasurer of Otoc now an inmate of the Lin sorving out a five yoars' sentence his crime. During his carecr as custodian of the Otoe county funds, his peculations and embezzlements amounted to something like §5,000, but what he ever did with this Iarge suim of- money has nover been _satisfac torily ascertained. The probabilitics are however, that he has a_safe “‘plant” sor whero and at the expiration of his scrvitude in the state prison he will emorge to enjoy the fruits of his colossal rascality. The de- fondants sucd conjointly with Simpson, wera the surctis on his ofticial bond. He is charged in this case with having in- tentiomally neglected to cancel throe rants issied at the instance of the county commissioners, two_for §1,000 each, and one for $500, on théir redemption, but in licu of this proper procedure, marked on them “Pre- sented, and nob paid for wnt of funds.’ Thus they appeared to be still unpaid and valid obligations of Otoe county, and to bear interest at the rate of 7 per cent per annum, Subsequently Simpson disposed of the war- rants for valuable consideratin, and upon their " presentation for payment the second time by the parties who had purchased them ~ of _ the dishonest._treasurer, the fraud was discov ered. Suit was brought against the county for payment of the warrants, and it natur- ally enough resulted in_favor of the defen- dant, as it was clearly proven that the orig- inal holders of the same had been once paid by the troasuver. Suit was then entered against Simpson himself, and sustained, but he never paid the indebtedness, and was fin- ally landed in the penitentiary for embezzle- ment. Now the plaintiff brmgs suit against Simpson and his sureties. District Court. Clerk Moores is busily at work on tho docket for next term, which begins the 14th.
