ITS REPERENCE 70 A SUBCOMMITTEE OF THE JUDICIARY COMMITTEE, ‘The action of the Senate judiclary committee yesterday in referring the nomination of Mr. Ful- ler, for Chief Justice, to a subcommittee instead of immediately reporting it for confirmation seemed to revive rumors of charges that Mr Fuller was a “copperhead” during the war. The demo- crats of the committee insisted that it was only fair and meritorious treatment, to report the nomi- hation favorably, but Mr, Edmunds preferred to send it to a Subcommittee. It is sald that formal charges or communications containing allegations against Mr. Fuller's loyalty have been laid before the committee, but a member told a ‘Stak reporter that ff any documents of that kind or charges of any character had been made he had not been apprised of it, ‘There 18 good authority for saying that if Mr, Edmunds had any reason to suspect Mr. Puller of disioyalty during the war he confided no such suspicions to the committee. In insisting upon referring the nomination to a sub- committee he indulged 1n no implications against Mr. Fuller’s loyalty or fitness, simply sa} ing that there was no occasion for haste; that as the Supreme Court will adjourn next Monday for the term there was no necessity for hurry. ing through Mr. Fuller’s nomination. ‘There does not appear up to the present tiie to be anything in the nature of charges before the Senate vr the judiciary committee, though, of course, the latter could conduct an investigation without the filing of formal chat It does not seem to be the impression of the Senate that Mr, Fuller's nomination will be hung up or unduly ay ‘The democratic Senators do not attach any spe- ¢lal importance to the published tions as Mr. Fuller's disloyalty.
