An intimate friend in thia city has re- celved a letter from him dated July 4th at Denver. Fuller said he was enjoying him- self to the utmost and in a fow days would leave for the mountains. In a short time he returned, and handed the man of pork and beof an envelope containing the pass. A Wicked and Waywerd Wife Tracked fo Her Crime, Proceedings Commenced in Coart by the Deceived and Broken Down Husband for & Divorce, Yesterday afternoon Lowls M. Smith, who says that he has been a resident of Omaha for three years, filed a petitlon in the district court paylng to be dlvorced from his wife, Mattle Smith. The charge he makes against her Is that of adultery, and speclfying that she committed the crlme July 8.h, 1885, at the Paxton ho- tel, with John F., Dobow, allas Ed Ward, whose right name is not known, In the petition Smith says that he was marrled to his wife November 24, 1881, at Conn. cil Bluffs, and has conducted himself ever since, with all the propriety, solleliude and honesty of a falthfal, {ovlng, up- right husband, who had the weolfare and happiness of his wite and famlily at heart. On the other hand, she, rogardless of her marital dutles, obli tions and vows, has at dlvers and sundry times gone astray with the man named in this particular instance and with other men, Mr. Smith aleo prays the court to glve thelr two children into his care and keeping, alleglng that the vicions and valgar habits cf his falthless wife, wholy unfit_her to be thelr educator and guardlan, The story of this unforiunate man’s domestlc life Is one calculated to ellcit for him the sympathy and plty of his friends, No doubt had he have caught ht of the smooth-tongued, flattering scoundrel who has boen the cause of his misery and sorrow, the other day, there would have been a tragedy. Wednesday afternoon thls man and his paramour entered the Paxton hotel and he wrote on the register “Ed Ward and wife, Councll Bluffs,” They were asslgned to room No. 30, and went up by the eleva: tor. Ten minutes later Mr. Smith entered theoffice, looked over the regtster excitedly polnted to the name of Ward and wife and demanded of the clerk to know who and where they were. His eyes gleamed like balls of fire and he trembled with nervous excliement as he sald to the clerk, “That woman is my wife.” “You don’t say so,” murmured the clerk, “I do say #0, most emphatically, and I want to see her, too; also the vlllaln who 1s with her.” In the meantime the clerk had dis- patched a bell boy to order Ward and the woman out of the house and say that Smith was there, with blood in hls eye and a hard shootlng gun. On hearing this startling information, a more fright- ened couple, no one ever saw. They got out and away from that hotel without a moment’s dely. The clerk managed to see Ward and gave him a polnter, about leaving town, the advisabllity of which he readily accepted and flew, as It were. Mrs. Smith did not return home, but s still In the olty. This team is known to every man, woman and child in Omoha and ail look upon them with pride and admiration. “‘Little Joe” was always a prime favorlte with the ladies and children becaute he is such a beanti- ful anjmal, always fall of life and dances along the street 1na manner which would cause anybody to admire him. *Frank” is greatly liked by the gentlemen, who regard him as a noble, true animal, and one always to be depended upon. Daring all the years this team have been In the fire servica they have been driven and cared for by Jim O'Brlen. To eay that they have had good care does not express It. No matter what time one dropped Into the englne house, the grays always looked as If they had just escaped from a band-box, so sleek and clean were they. Jlm had/come to love the grays as well as any man can love a dumb brute; in fact they only took second place for his wife. THE BALLARD CASE, How the Convicted Murderer Looks and Talks—The Motion for a New Trial. Yeaterday a reporter had a fow moments convereation with Thomas Ballard, re- cently convicted of murder In the first degree. The unfortunate manls kept confiued In the county jall, in one of the Inner oages. Contrary to expectatlon, and to his hablt before the trlal, Ballard talked freely. His appearance has ohanged greatly even aince the trial. He Is aging rapidly, and the fall realization of his position seems to be welghing upon his soul. When talking, his eyes roll rostlessly from side to side, and hls every appearance Is that of a nan whose nervous system s completely wrecked. *I dldn’t expeot, when I llstened to the evidence,” he sald, ‘‘that the jury would be so hard upon me, I didn’t think that their verdict would be as cruel as{t was. I can not see how it could have been.” *‘Do you confess to having murdered Verpoorten?” was asked of him. “‘No, oh, no! I can't confess to that. I don’t believe that I ever murdered him. 1 haven’t got the alightest recollectlon of it. Everything connected with that is a blank, Why should I want to kill Henry,” he continued, plaintively. ‘I was always a good frlend of hls—he of mine. I have known him for seven years and we were always on friendly terms, ‘We used to be together a great deal ot the time; used to go to the theatre together; used to get on sprees tegether; uset to sit up at night together, and never quar- reled. “Yes,” he contlnued, in a wandering sort of & way; “‘yes, I might have been drunk. I always ueed to get drunk whenever the notion took me. I could not help it.” In answer as to a questlon about his hopes of a new trial, Ballard sald that he knew nothing or the matter. His attor- neys had the matter in charge and would do all they could for him. Gen. O'Brlen, in conversation with the reporter yesterdsy,sa'd that he would file his motlon for & new trlal to-day, The arguments would pot be made until work on the criminal docket had closed, probably week after next. AN EVERY DAY NUISANCE. A Plaintive Waii—The Agony ot Try- ing to Stop a Street Oar, “There Is one nulsance that s growing more and more abomniable,” sald a gen- tleman to a reporter yesterday, ‘‘and that is1n connectlon with the ranning of street cars. Ihavebeen in Omaha but a few months, but I mast say, asa role your street car drlvers are the most unaccom- modating, not to say negligent, lot of men I ever saw. Why do I think so? For one reason eapeclally. It ls almost impossible sometimes to get them to stop for passengers when they ought to. A man can shout and whistle all he pleases to attract the attentlon of the driver on a car he wants to board, but the chan- ces are ten to one that the sald driver won't stop, It may be that he dou’t hear, but I don’t believe it, More prob- ably it Is because he don't heed. The driver of a street oar, If he understands his business, will look from side to slde occaslonally to seo whether there fs any- body desirlng to board the car. Baut your Omaha street car driver doesn't think of such a thing; oh, no! He is above such petty things. A Young Granger Robbed of $80 This Morning at the St, Paul Depot. Yesterday morning as the C. St. P, M, & O. traln was pulling out twe sharpers robbed a young granger, by the name of P. J. Gustafson of §30 In money and jumped from the train, making good their escape. Young Gu:tafson had his money in bis pants pocket and changed it to his tnaldo coat pocket. This move was noticed by the sharpers and one ap- proached him aud asked him for change for a $100 bill. The young fellow put his hand io his pocket and preduced the roll of biils, whereupon the sharper enatebed it from his band and jumped from the trsin, followed by his compan- on. oung Gustafson also jumped trom the train and es it was moving quite rap- laly by this time, fell and was somewhat injured.
