Morgan-Moore-McFariand Cousames the Time of toe Conrt Again, A General Bkirmish to Secure a Pickpocket's Release —De- cision To-day- The habeas corpus case which last week began In the county court and since that time has dragged its slow length along, was called at 2:30 yesterday even- ing pursusnt to order of adjournment, with an array of Nebraska and Iowa at- torneys within, and a morbidly carlous orowd without the bar. Over all pre- sided his honor, calm, firm and undis- mayed, even by the huge piles of hooks lying on the long table and threatening to test hls patience to the end. A succlnet review of thls ocase will enable the reader to understand what tho ismuo yesterdsy was Last week Censtable Edgerton, of Omaha, spotted a man in the city whom he was half satis- fied was wanted in Iowa, and had been for some time. The pollce of the city likewise knew of such a man, and the re- sult of the captare was his lodgment in joil upon & criminal charge, At once the telegraph informed D, A. Farrell, sheriff of Mills county, lowa, that a man answering the description of the badly wanted Iowa man was here and lodged safely behind the bare. Farrell hastened hera as fast as steam could bring him to Identliy and secare - — _ tificate of that court by false representa- the fagltive, when, not much to his sur- prise, he was mothy & wrlt cf habeas corpus, directing the Immediate prodne- tlon of the man’s body, which he had gotten possession of from the Nobraska officers, who had also been served with a similar writ. Well, the case finally got before the county judge, the issus being the Iowa officer’s RIGHT TO HOLD and carry back to Iowa the person in question, The polley of the Towa men was to hurry him off, that of the couneel to de- lay. Suddenly it appeared that there would arlse some question of doubt AS TO IDENTITY, and then the tables turned, and the Iowa man was willing to postpone (his objoot was to get testlmony here), and the man’s counisel pushed for a hearing. The case was set for Friday last, and after a considerable delay was set agiin for yestorday forenoon, aud again set for 2 o'clock p. m., when the fight finally opened. M'FARLAND, who has, among heaven only knows how many more, two alisses—Gordon and Moore—olaims to be an Indiana man by birth, He has a young, preity and lady- like wife, whote demeanor has touched the better feellngs of every man con- nected with this case, and (he says) he has a circle of friends and relatives who are good people. Beo this as it may, he owns a face that would be at home in a collection of bad people and a record that is & fit companion for such a face. Six years ago ho was sent to the Towa penitentlary for one year under the name of Moore for larceny from the peraon (vlz pooket-ploking). He was young and was allowed by the keopers of the prison to do odd jobs outside. He had four months to ssrvo when, one day be- ing iu the yard, he went toa closet, donned 2 pair of overalls and escaped. Since then he has led the life of a confi- dence man and professional pickpocket, and ls, so the cfficors assured the re- porter, one cf the best known and clever- est pickpockets in Towa to-day. Daring his six years absence the pen- {tentiary ofticlals and the Iowa authorl- tles have often heard of his rascally do- inge, but never until laet week got the opportunity to bag him. And now, 8o far as tho desire to have him serve out the four months remaining of hls sen- tence goes, it is possible there is no great interest felt in his capture, but as an ex- ample for convicts who are left behind him, and in the intsrest of prison dis- clpline, as well pcrhaps s to heal the chagrined feellngs of the penitentlary keeper, the officers seemed determined from the begloning to convey him to Fort Madison prlson if possible, The hope of bis roscuo from the vice-like clutch of Sheriff Far- rell, seems to be based on the idea that the grounds and testimony upon which Governor Dawes lssued his letter of an- thority to Farrell to take him back, should appear In this court and be offered by the ofticer having the commission of authorlty, That otherwise the authority is Inadequate for his legal removal or re- taining. A" Fowler, fourth, $50. The desiga which has been adopted provides for the erection of a splendid stracture, composed of red pressed brick and terra-cotta {rimmings. The wall spaces ara broken by large window openings, trimmed with richly moulded brick at the joists, and panels of ornamental brick between the arches and sills. Massive stone basoment walls and entrances framed in rough and pol- ished granite columns with curved capl- tals complete the exterior.
