Away this Mo As the announcement was mado sat #lay that Dan Allen was dead, many w sporting man in this city could not re frain from brushing away a silent tear. Not among the sporting fraternity of this city alone does the death of this man cause goneral sorrow, but all over these United States, for the name of Dan Allen was familiar in almost every city upon this contineut, where sporting men hold forth, Dan Allen was born at Felts Mills, Jefferson county, New York, in April, 1830, At an early age he commenced work upon the Erie canal, After remain- ing there a few years he went to work on the Michigan canal in lilinois. He went from there to steamboating., Later, he opened a saloon in Peoris, Llinois, which place he run but a short time, when he bought a steamboat of his ow; He run this boat about three years, du time he made considerable moncy. In 1866 ho came to Omaha and opened a saloon. After this he opened & faro bank. He was the proprietor of agambling house in this city for over thirteen years. About vight years ago he was attacked with kid- ney trouble, from which he never recov- ored. Last June he went te various places in search of relief, but found it uot, and returned to this city in Septem- ber to die. Since his return he was con- tined to his bed, excepting a few days in January, when he was able to be around. At this time he contracted a severe cold which terminated in pneumonia. From this came consumption which caused his death Saturday moining at 6 o’clock. Dan Allen was always known as a fair and equare man in his business, and was honored by all his associates and friends. His word was always regarded as good as his note and all were ever ready to take it. He was liberal at all times and never needed asking todonate to any charitable cause. During his early days, when upon the canals and river he was regarded as a hard man te handle and it was seldom that he fourd his match in any athletic sport. He was a good man in every re- spect in his class and his death, which has long been expected, is deeply de- plored by all the sporting fraternity. His funeral will occur tnis after- noon, at 2 o'clock, from his late residence, 016 Dourlas street. Friends are invited. e —— An End to Bone Scraping. Prentiss Ingraham, filed a petition before Judge Lubke, in circuit court No. 2, praying 1| for an injunction to restrain Dr. Wm, ¥. Carver from giving an exhibition this afternoon, and advertised as the “Wild Weet.,” The petition set forth that *“The Wild West” is copy- righted and is the sole property of Wm. F. Cody, better known as **Buffalo Bill,” Other sllegations were set forth in the petition, which the Judge examined and issued an order returnable at 10 o’clock this morning. After the injunction had been disposed of the same attorneys filed attachment suits agaiust Dr. Carver for printing accounts, the sum due amount, ing to about $2,000. The papers wero at once made out and jssued to the sheriff. It being ascertained that Dr- Carver and his combination were coming to the city from Memphis on the steamer Baton Rouge, which was expected here in the evening, copies of the injunction and attachments were giv en to Deputy Sherifi Wheeler, who was instructed to seive them, The boat reached the Anchor Line wharf at 7 o'clock p. m.,and Wheeler immediately went on board, served the tnjunction on Dr. Carver, who manifested eurprise, but readily acknowliedged service. The deputy also attached thirty-one head of horses, several vehidles and other proper ties. Soon after Dr. CarVer was driven in a camage to the Southern Hetel, where he consulted with his attorney, Judge Lindley, and made arrangements to replevin the articles attached ard fight the injunction in Judge Lubkes Court, Dr. Carver, in conversation witk a Globe-Domocrat reporter, said that either combination in his eatimation was enti tled to the use of the name **Wild we: Last year he and Cody (Buffalo Bill) traveled together with a show called the Golden West. In October last the com- pany broke up, but nothing was said re- gording the use of the Wild west or any other name. Dr, Carver asserted that the rival concern wanted to apoil his bus. iness by starting o legal fight. He wus confident, however, that he would ba successful “in the court proceedings, but would disappoint his enemies, even if he had to give a free exhibition, or under another name, The other side presentsa strong case. Col, Prentiss Ingraham, who is acting for the*‘Butfalo Bill"” combination, claims that the proceedings against Carver are fully justified. The whole fight by the ‘‘Buffalo Bill" Wild West, as as erted by him, is based on three grounds, viz: 1. That the title is copyrighted and that W, F. Cody is the soleowner. 2. That Car- ver is trying to exhibit on the billing of Cody's combination, 3. That he sgreed not to interfere with Cody’s exhibition.
