Des Moises, May 9.—The Uai Statee district court, now sltt this city, this morning rendered a do alglon in the celebrated “‘drive we!l’ case, holding the patent void. The question was decided in the case of Andrews vs. Hovey, of Indepondence. The case was broaght before the courts of Towa and Minnesota together, the judges being Love and Shiras, of Iowa, and Nelson, of Minnesots, and is conclusive as to all cazes pending in both states. Judge Shiras delivered the opinion, holding, First—That the pstent is invalld because the inventor, Col. Green, of New York, allowed it to go into public use for more than two years prior to nis application for a patent. Second—That the f{ssue was vold because it was not for the same inven- tlon as the original patent; and Third—Because that the instances of priority by the inventor were in the main mere experlments of wells at | th Independence, Iowa, in 1861, and the successful use of several wells at Mil- waukee in 1849 and 1850 were from substantially the same inventlon. JudgeLove concurred and held further that under the act of congress of 1839 it was immaterial whether the prior use of the invention for the two years thereln mentioned was with or with- out the consent and allowance of the inventor, and that such prior use in elther case Invalldated the patent.
