In the star route trials Bliss an~ nounced they were through with the exception testimony of Ex-Senator Spencer, who had left town, and asked. postponement till he could testify. The court dented the motion. The evidence closed on both sides and the: court took a recess. Affiant further says it is not true that thik afliant, subscquent to the conver- sation tostitied in this case as having oceurred between Rerdell and James, and Rerdell and MacVeagh, that this affiant went tor the room of said Spencer in the Kvers ott house, New York, in great trouble: and despondency, and stated to said Spencer that his clerk had gone back on him and given away the whole story, and had destroyed the whola businees, with inore to that effect. Affiaut is further informed and be- lieves said Spencer was here mattend- ance upon this ceurt for a long time, and ho is mformed that ho (Speucery frequently asked to be put upon the stand in this very case, frequently stating that ho knew untllinu againat this afliant, and could testily to noth- ing that would in tho slightest degrea implicato this afliant or show that e had ever conspired as sct forth in the indictment, or had done anything illegally in connectiopn with star routes. Affiant further sayn he is informod and belioves, in fact, knows, that said Spencer was her in attendance upon this court for a long time, and frequently asked to be put upon the stand, stating that his private business was suflering and that it was of great importance to him: that he be examined at once and dis~ charged.
