Brown Gives It Up and the Charge of Larceny is Absndonead, Other Doings of the Conrta, Yesterday morning the case of the state va. W, ), Brown was again called up in the superior court, the evidence not having been concluded on Satur- day. It will be remembered that Brown was charged with having stolen a silver watch from the man Jones, who died in the pest tent and upon whom Brown and his wife attended. Tho information lodged against him placed tho value of the watch at §50, which made the offense one in which the examination was nocessarily a pre liminary one instead of a final trial The witnesses for the state, however, placed the value ot the watch at only 815, which changed the case to that of poetit larceney. 1Instead of filing a ow information the state conclufed undon the case altogether, on the ground that there was some doubt as to whether it could bo proved that Brown really converted the watch to his own use. The accused was there- harged, The has 80 excited comment and called forth so much indignation against a man supposed to been guilty of stealing a dead man’s watch that it is proper to give the public briefly both sides of the story, It i claimed that when Jones was hrought to the pest-tent, Mr. and Mra. Brown, the former of whom had just recovered from the disease, wero in attendance. There being no time- picce by which they could tell when to give the medicine, Jones let them have his wateh for that purpose. The watch hung in the tent, and was used, until after Jones' death and burial, when Brown’s brother came to the tent from thia city, and Brown gave him the watch to take away, saying that he did not the police to sce it, as they would not allow any clothing, and not even a pin used in the tent to be taken away, for fear of spread- ing the disease. Afterwards Kather McMenomy, in response to a lotter from the boy's father, got Officers Sterling and Cusick to hunt up the Watch, Brown told them and others that it was buried with the body. There was witnesses also who said that Mrs, Brown offered to sell the watch. Brown's eide of the story is to tho effect that the young man Jones was anxious to very receive extra good cato, and that besides loaving the watch for the purpose of telling when to give the maodicino, that he told Mrs. Brown that if she would take good care of him, he would give her the watch, but that if he died, and his father wanted it, it should be turned over to him, He also promised that the Browns should be paid $100 for taking care of him. After Jones' death they were afraid they would not be allowed to take the watch away, and so sent it out of camp. _Mrs, Brown thought she had a8 good a right to tho watch as the officors, and supposing that the latter had no authority from the young man’s father, the statement that it was bur- ied with the body was given to throw them off the track. Mrs, Brown claimed that she own- ed the watch under the simplo condi- tion that she shall give it to Jones’ father if he ever came after it, and that on two oceasions only did she lot Brown carry it, on one of which he was arrested, The case was dropped on condition that the watch should be left with tho clerk of the court to be turned over to Father McMenomy or to the father of Jones direct. The case hasa bad look for the Browns, but it is well that no pro- longation of the trial was had, involy- ing, a8 it did, 80 many witnesses lu from the pest-tent, and exciting so much nervousnees as to the probable exposure of the public to a further spread of the discase, There were several cases of less im- portance handled in the courts yes- torday. James Russell, plain drunk, was one of them, who pleaded guilty and was given tho regular fine of city of the first class. Honry Adams, charged with assault- ing a r:ung fellow named Danforth, or rather threatening to assault, had a hearing before Justice Frainey and was discharged. 0. F. Snyder and Charles Beemer were complained of for fighting, Sny- der appeared, and it appearing from his statement that ho was forced into the fight in self-defense, and no wit- nesses appearing to contradict that statement, he was discharged, Bee- er has not been urrested, Samuel Willinms, brought before Justice Frainey, charged with trespass and the larceny of wood, took a charge of venue to Justice Abbott, who dis- missed the first charge on account of a faulty information, and on trial Wil- lisms was acquitted of the second charge. James Quigley, alias Hutchins, a plain drunk, was fined by Judge Aylesworth yesterday. ——— Baby Baved?
