In case of omissions, errors or mistakes in making such assessment or levy in respect of the total cost of the improvement or deficiencies or otherwise, it shall be competent for the council to make a supplemental asecssuient and levy tosupply such de ficiencies, omissions, errors or mis takes. The cost of paving, macada mizing or repaving the interscotions of streets and space quumo alleys in any paving district shall be paid by the city as hereinafter provided, but noth ing herein contained shall be construcd to exempt any street railway company from paving or repaving between its rails at lits own cost whenever any streot shall be ordered paved or re paved by the mayor and council of the city as provided by law. For the purpose of paying the cost of paving, macadamizing or repaving he streets and alleys in any paving tdistrict, exclusive of the intersection of streets and space opposite alleys therein, the mayor and council shall have power and may by ordinance cause to be issued bonds of the city to be called “District paving bonds of District No, —,” payable in not ex ceeding five years from date, and to bear interest payable annually not cx ceeding the rate of seven per cent. per annum with interest coupons attiehed; and in such case shall also provide that said special taxes and assessmonts shall constitute a sinkivg fund for the payment of said bonds and interests Provided, that the en'ire cost of pav. ing, repaving or macadamizing any such gtroets or alleys, properly charye- ablo to any lots or lands within any such paving district, according to the front feot thereof, may be paid by the owner of such lots or lands within fifty days from the levy of such special taxes and thereupon euch lot or land shall be exempt from any lien or- charge therefor 8eid bonds shell not be nold for lees than their par value, or if said assessments, or any part thereof, shall fail or for any reason be imvalid, the mayor and council may muke other and further assessments upon such lots or lands as mey be required to collect from tne samo the cost of any paving or mac- adamizing property chargeablo there to, a8 herein provided. Whenever the mayor and council deem it expe- dient, they shall have the power for the purpose of paying the cost of pav- ing, repairing or macadamizing the intersections of streets and spaces op- posite alleys in the city, to issue bonds of the ity to run not more than twenty years, and to bear interest ble semi-annually at a rate not exceeding six per cent per annum, with coupons attached, to be called ¢*paving bouds,” aud which shall not bo sold for less than par, and the pro- ceeds of which shall be used for no other purpose than paying for the cost of paving, repairing r macadamizing the intersections of streets and alleys in the city. Provided, that the agure- gate amount of such bonds issued in any one year shall not exceed the sum of $100,000; and, provided further, that no such bonds shall be issued until the question of the issuing of the same hus been submitted to the electors of the ity at a general or special election therein, and author- ized by a vote of the majority of the electors voting atsuch election. If in any city of the first-class there shall be any real estate not subject to assessment or epecial taxes for paving purposes, the mayor and council shall have power to pave in front of the same and to pay the cost thereof that would otherwise be chargeable en such real estate, in the same manner as herein provided for the paving of intersections of streets and paying therefor. The word “'lot” as in this act used shall be taken to mean a lot as described and designated upon the recorded plat of any such city, and in case there 18 no recorded plat ot any such eity, it shall mean o lot as de- scribed ~ and desiguated upon any generally recognized mup of such city. The word lands shall mean any un- subdivided real estate. L'nat secaon 43 of said act be, and the sume is amended to road as fol- lows: Sec, 43, Such taxes shall be levied on all the lots and land bounding or abutting on such im rovements, said tax to be either in proportion to the feet front o bounding and abutting on or according to the value of such lots or lands as shown by the last previous assessment thereof for gener- al city purposes, ss the council may in each case determine: Provided, That this provision shall not be taken to apply to special taxes or assessments for paving purposes except as provided in section 42, Provided further, That when any such improvement shall extend into or through any unsubdivided tract or|"% parcel or parcels of land, said taxes shall be #o levied as not to be charged against the real estato adjoining such improvement for a greater depth than the averege distance through the sub- divided real estate to be taxed for said purpose. Sec. 11.
