On Saturday afternoon the case of Dr. Pinney, charged with “‘attending upon a case of small-pox within the city upon the 5th day of May and for several days provious, and did fail to report the same to the authorities,” was taken up and tried. The small-pox case referred to was the one at the Emmett House, and the evidence showed that the man had been ailing for two or three days, and on Tuesday night, May 2, one of the boarders named ‘‘allahan called Dr. Pinney in to see him and guaran- anteed the doctor his fee, as the man had no money. Dr. Pinney found no symptoms indicating that the man was seriously ill, and none indicating that he had the small pox. He gave a prescription and left, with the distinct under- standing that if the man was worse or he was needed, he should be in- formed He never heard from the man after that until Friday noon, when another messenger came, saying the man was worse, and that his face had broken out. Dr. Pinnoy told the mensenger that it was a county case, and perhaps it was a case of small pox, and advised him to see the overseer, Mr. Burroughs, and Dr. Hart, the county physician, There his connec- tion with the matter ended. The mes- senger went to Dr. Hart’s and left word for him to go the Emmett house immediately cn his return home, he being away. Dr. Hart went to the Emmett house about 4 o'clock, and found a full-fledged case of small pox, and in his judgment it was in the fourth day of eruption. Arrange- ments were at once made to remove the patient to the pest house, and in the evening he was taken thither. De. Hare informed the police that in his judgment there had been gross neglect on the part of some one, that many people had been exposed and that he feared a serious time would result. He mentioned Dr. Pinney as having been in attendance upon the case, Chief Field relying mainly on the information which he gained from Dr. Hart, filed an information against Dr. Pinncy for ueglecting to report the case. Judge Aylesworth, in deciding the «case, discharged the accused. Sarar Station (N, M), May 4.— Having just returned from the scene of the recent Indian slaughter in Mox- ico, T send you the following dotails of tho affray: The Chiracan and Warm Spring Indians under ‘‘Ju” and “Luco,” their chiefs, with squaws and papooses, about 300 in number, after the fight at Horseshoe Bend, A. T., retreated toward old Mexico by way of Galeyville, with General Forsythe and nine companies of U. 8. cavalry in hot pursuit. The Indians retreated southward through the Animas valley in New Mexico. They were pursued for thirty miles across the Mexican border and close to the Hannas river in Mexica, when about 260 Mexican troops belonginging to Gen. Terasas' command, were concealed in a small willow-fringed creok, & tributary to the Hannas river. The Indians, un- aware of the ambush into which they were being driven, fell into the trap. The Mexicans lay perfectly quiet un- til the Indians were within a hundred yards of them, and then poured in a sudden and murderous fire. The de- struction was almost complete. Sixty warriors fell at the first volley. The young and vigorous warriors scattered and hunted cover. The Mexican sol- diers then charged upon the old bucks, squaws and papooses, who formed the center of the column. None were spared. Squaws were bayoneted, and the children end babes taken up by the heels and their brains dashed out agamnst the rocks. One old gray- h-aded Indian died game.
