(Special Correspondence.) Bismarck, March 21.—Through the refusal of Insurance Commissioner Taylor and Chief Justice of the Sup- reme Court Fiske to approve the plan, the act creating the new state bond- ing department will not be held up and made inoperative until the sup- reme court of the United States can _ pass on it. The state supreme court recently held the act constitutional and the -state can now go ahead and put in its bonding department, which will bond all city, county and state em- ployes, instead of these employes being bonded by insurance companies. The plan, however, was to get two or three years delay in putting the act into operation, by a stay of pro- ceedings until the insurance compan- ies, which have attacked the law, can take it fo the United States supreme court. In the mean time the compan- ies would continue to write bonds, Strange to say, Attorney General Linde, who represented the state and defended the constitutionality of the law in the state supreme court, agreed to this stay of proceedings wanted by the insurance companies. The attorney general entered into - a stipulation with Attorney Aubrey Lawrence of = Fargo, representing B. V. Moore, a private bonding com- pany official, agreeing to hold up the operation. of the law. But Insurance Commissioner Taylor refused to sign the stipulation. Then the attorneys sought a stay of proceedings from State Supreme Justice Fiske, who also refused to agree to the delay, al- though the attorney general had agreed to it. WILL SAVE TAXPAYERS THOUSANDS OF DOLLARS. It was at first thought that the state insurance department would not have funds to make the new act oper- ative, after it had been upheld by the state courts, but State Treasurer Steen has now agreed to advance funds and Insurance Commissioner Taylor will proceed to write bonds for city, county and state employes. The legislature failed to appropriate spe- cifically to establisk the department, but Steen’s agreement obviates this. The new state bonding act bids fair to save the state and its political sub- divisions thousands of dollars :annu- ally formerly paid out.to private bonding companies -:‘'on .premiums which were declared to be excessive. The state can now issue these bonds at much lsss cost and at the same time fully protect itself and cities and counties against loss by any acts of public employes. The insurance companies sought to have the law declared unconstitutional but the supreme court held it violated neither the state nor federal constitu- tions. The companies intend to take it to the supreme court of the United States, but in the meantime the law will be operative in North Dakota, in- stead of held up, as the attorney gen- eral wished, until the United States courts can hear and decide it, perhaps in two or three years.
