THE COURTS. _ Cause of the Explosion of the Steamer Adelphi’s Boiler, A FISHING EXPEDITION. Efficient Member of Nan the Newsboy's Life Saving Corps. The suit brought against the Columbia Steam Navigation Company for $5,000 on account of the death of Miss Sarah Leonard, through the explesion off Norwalk, Conn.,on the 28th of last September, of the boiler of the steamer Adelphi, was continued yesterday before Judge Barrett and a jury. Mr. Donnis McMahon, counsel for the defendants, called Mr. John A, Fease, who testified that he was by edu- cation a mechanical engineer and had been such about twenty-nine years; had learned tho trade of boiler making and had run various large steamboats as thief engineer over twenty years; had also been’ Licensed by the government as inspector; he wos the superintending engineer of the defendants’ line, and also a stockholder inthe company. He confirmed Mr. MeMahon’s opening as to the criginal examina- tion of the boiler in question, and the work done on the boat and its boiler and machinery. It was put in perfect order. He gave it as his judgment that the explosion was the result ‘of n laminated sheet being originally put in the boiler, which had become disintegrated by constant action of the boiling water, the steam and tho salt in it, which, in the course of three years, wore away the iron boiler plate at the point of fracture to the thin space it presented after the explosion. This _ witness showed tho jury on the large sheet of boiler fron, which Mr. McMahon had brought into court, and which was annexed to the fractured sheet, points wherein that sheet also apy 1d to be laminated, Ho thought that after this unsound sheet of iron, which was exploded apart, had been incorpora nto the boiler originally it could not ,be detected even by the closest scrutiny. Froim the outside the only mode of detection would have been the testing by a hammer struck on the outside, but even then that test could not be successfully applied here, in- Asmuch as the point of fracture was too near the aap of the sheets. The witness was cross-examined at great length by Mr. Christopher Fine, counsel for the plaintiff, but his san did not materially vary from his direct. Mr. ‘MeMahon then called Mr. Bromley, superintendent of the Quintard Iron Works, who said he had had an experience of thirty- five years as a mechanical enginecr and a draughts- man ot boilers and gave very important testimony on the pressure such a boiler was able to bear. Assum- iny its diameter of sholl to be 94, feet and the tensile strength of the iron used in it to pe 50,000 pounds, it could, he said, stand the pressure of forty-five pounds and a fraction to the square inch of surface. He agreed with Mr. Peaso that the cause of explosion week defective laminated shoot having been used 1m the boiler in its original construction. After the sheet had got into the boiler it could only ‘be detected in three ways—by the hydrostatic press- ure being put on it, by internal examination and by external hammering. On looking at the fsorg of the boiler he thought no ‘one oonld getin that part of the boiler and examine it from the in- side; it could only be done by outside hammering; he was of tho opinion, on being shawn the sheet of beiler in court, that ahammer could not be applicd to itaud detect the difference of sound, as at that point of the boiler it was too well braced to admit of the necessary sound being made by a haminer. Tho testimony of this witness, which, as wil} bo seen, Was very important as ‘ing upon thé point ut issue, will be resumed this Morning. A FISH HARD TO CATCH, Samuel Fish, a resident of Providence, R. L, was sued by William Dano and a judgment obtained against him for $150, in the Marine Court. An exe- cution was issued and the Sheriff returned it unsatie- fied, On tho 20th of January last, while in this city, Fish was served with on order to appear and be ex- amined on tho next day supplementary to execu- tion. He disregarded the order and was next served with an order on the 14th day of February follow- Ing, to show cause why hé should not be punished for contempt of Court, He again tailed to appear, and Judge Sinnott, upon application of the plaintiil’s attorney, issucd an attachment to the Sherif to arrest Fish, He was tound to be a hard fieh to catch, but at last the hook of the Sheyif, baited with the attachment of the Judge, succecded in catching him. Mr. Alfred Steckier, his counsel, mude an bp eges to discharge him trom arrest, claiming that he was not guilty of any in- tentional contempt, but that ow! to circumstances which he was unable to control he had je:l to attend the examinations, und therctore should be discharged. JUDGE FREEDMAN DISMISSES THE SUIT OF THR NEW ENGLAND TRON COMPANY AGAINST THE GILBRRT BLEVATED RAILROAD COMPANY, The suit of the New England Iron Company agrinst the Gilbert Blovated Nailroad Company to re- cover $4,000,000 for an alloged breachof a contract to constrict the present Sixth Avenne Elevated Railway has come to a somewhat inglorious conclusion. THE NEW YORK ROAD, The general disappointment felt by the public at the failure of the New York “‘L” road to keep its City Hall branch open on Sunday caused inquiry to be made at the office of the company yesterday. Mr. Cowing, the treasurer, said that he did not know why the branch was closed and was undecided whether it would be kept em. hereatter on the Sabbath.
