_ THE COURTS. Legal Deductions and Moral Teachings of the Noe Suit. AN OCTOGENARIAN’S ESTATE 4 Patched Petticoat as the Reservoir of Feminine Funds. TWEED’S FORLORN- HOPE. In Supreme Court, Chambers, yosterday, presided over by Judge Westbrook, there was a very large at- tendance, attracted there, doubtless, through expecta- on of further interestiug devolopments in the suit of Isabolia B. Noe against her husband, William F, Noe, In this anticipation, ho ir, the crowd was disappointed, no new facta in this very singular case having been brought to light, but the further procee: ings simply comprising a very lengthy aad of course learned but almost wholly dry argument on tech- Qieul legal questions between the respective counsel, General Sandford and Mr. John D, Townsend, The lat- tor opened the argument, He contended that tn order io eithor obtain an injunction to restrain the defendant from disposing of bis property or the appoiutment of @ receiver to take possession ef the same, it must ay pear that the plaintiff is entitled to the relief demanded and that tt did not appear by the moving papers either that the plaintiff 18 eutitied to the relief demanded or that her rights with respect to the subject of the ac- tiou are being Violated. He cited trom Payo’s Chan- cory Reports a case he claimed to be even stronger than the present one, in which the Chaveellor held that the Court bad no right to interfere with the husbaad’s property ugiess he had committed an act justifying a separation or divorce, He said that no such thu was charged in this complaint and that it was bot even charged that this property came into bts possession through any fraud on bis part, and hence thatthe Court bad no right to direct him to reconvey. He :maisted that the Court should not ald the plaintiff by aflording her 4 maintevance while sho continues to reside apart from ber husband without any justifiable cause or without bis consent; that there was @ Vulid consideration in the love and effection which she bore him at tho time of the conveyance, and which her letters indicated she still bore him, and that the conveyances were under seal, which aiways implies a doliar’s consideration ut least, which 1s suffl- cient, He urged, turther, that before au action wo compel a reconveyance of property could lie the plain- if should have tendered a deed tor the defenduat’s mature, which had not been done; that asthe defendant Bad reeeived the property tnrough his fathor the proper action for the plaiuuif! would be to bring an Qction to have the conveyances she made set aside, and that this would bave necessitated tho impleading of the defendant’s father, rf. lownsend closed by con- tending that it was tne must benigy vilice of tue Court to maintain barmony between busbaud and wile; that it should frown upon this endeavor to separate two whose affectioa was indirectly strong each tor the otuer; that seldom has a husband had worse tr j% month ago an aflectionate letter from bi wile, then a .retusai to seo him or make any explana- tion, and then a report in the newspapers of ber side ot the case, representing him to be a vagabond of the deepest dye. General Sandford followed with an elaborate argu- mentinreply, He cited various English authorities viaimed tu be germane to the casy, under which he contended that the Court had a right in a case where bo actual iraud was ghown in obtaiuing conveyance of property by the wife to the husband, yet if the Court Saw that it was a manilestly improper trausior the Court had a right of adjustment He proceeded to re- ply at length to the various points raised by Mr. Town- sead, claiming that the plaintiff should bave tbe r lief demanded in the complaint, and thus from her original large estate have some small remnant lett to secure her a future tneome, Juuge Westbrook said that if it was entirely satis- factory to both parties he would hold the papers and see it the parties could vot come together wha agree Upon somo investment of the remaining iunas tor the beuefit of both, adding that it Was upparent from the letters which the plamtif! bad recently written to her husband and to nis family that se had no great cause ot grievance against Bim und was apparently still fond of bim, ‘ir. Townsend said that he could not permit tho statements agatust bis client, uncorroborated by auy ailidavit bevond the one on information and belicf of the plaiutiff charging the defeudant with gross ex- travagance and immoralities, to go unanswered, Alter some lurther argument Judge Westbrook took the papers, AUNTY MORE’S ESTATE, Forty years ago Jemima More was lett a widow, and during the whole period of ber widowhood was a resi- deni and weil Known in the Eighth and Sixteenth wards of this city, untii about two months ago when, with bated breath and feolings not uumingied witn sorrow and curiosity, female noighbors whispered to each other, “Aunty More is dead.”’ At the time of her death she lived ina modest and somewhat obscure trame house in Varick street, and had failed in reach- ing the proverbial four score by but a single year. During all the years of hor widowhood she lived much retired, aud owing no debts ard seekiag ald of none became a subject of curiosity to ber neighbors, aud the source of ber income and means of support wero almost as much a mystery as the burial piace of Captain Kidd’s treasure, After her death ber nepliew, Alexander 8, Knowlton, presented in the Surro- gato’s office for probate the will of the deceased, and on the 4th of September last i+ was duly admitted by adecree of the Court, By this will the property of the deceased was bequeathed 1n eqaal shares to Mr. Knowlton, who was made exccutor; to another nephew named Israol Lockwood and a grand nephow named Janes Shurden, In the Surrogase’s Court, yesterday, Mr. H. F, Marston appeared as counsel for the executor to answer to an order to show cause why his client should not tarnish security for the proper execution of his trust, or else give place to some other person who would, This order to show cause was gruuted on an uilidavit filed vy Mr, Louis J. Grant, counsel for the other legatees, in Which it was charged substantially that the present executor ts a man of a0 substance, ‘and that bis conduct in relauon to the estate so fur was such as to excite fears on tho part of the other — legacces for the safety of the estate, Among the reasons sev forth to sustain this belie! was the allegation that tho executor had bitherto given bis co-legatees no Batisfic- Mou as to the probable amount of the estate; that a search among the savings banks of this eity had dis- closed the tact that the executor had drawn cut of sev- eral of them over $2,000, which had been there depos: {ted to the credit of the deceased, and tad deposiied the sume in other bunks, not to his credit as executor, Dut as an individual; (hat being thus deposited the ex: ecutor was iree to draw it oulat uny ume, aud that bis co-leg ates believed if he was pressed in the setule- Ment of the estate he would so draw it out aud go to sea, On the part of the executor an aiiduvit was placed on file 1p respouse in which all the allegations of the complaining alfigavit’ except that as to his appointment as executor were de- nied. lt was argued on the executor’s bebuif ‘uut ho having been appointed such by the torms of the will, without security, and baving actually eaiored pon the duties of fis’ trust, Ube allegations of the complaining aifidavit, made merely as an expression bi belief, Wore insufficient, especially so us those alle- gations were denied by the alfidavit then placeu on tile by the executor. ‘The Surrogate said that notwithstanding the fact ot & person being appoiuted executor by tue terms of tho will without the necessity of giving security, it it should subsequently be made to appear that the execu. tor 60 appuinted Was Without means, or Lad commu fed cts tending vo show that the estate was cudun- gored in bis bands, he would take into consideration ‘Qn appheation for bis removal, Ln tbis case the alie- ations of the petition being contradicted ou the part | of the executor he would order a reterence to take | testimony as to their truth, in the meanume, and until the coming tu of the reierce’s report, tue execu. tor would be restrained from interfering with the us. tate. A feature of this caso is that Aunty Moore could neither read nor write.
